## RURAL MUNICIPALITY OF PERDUE NO. 346
BYLAW NO. 2025-5
A BYLAW TO REGULATE THE SPEED OF MOTOR VEHICLES OVER 10 TONNES
The Council of the Rural Municipality of Perdue No. 346 in the Province of Saskatchewan enacts as follows:
In this Bylaw "Designated Officer" means a person designated by a council or a person to whom power or authority is delegated by the administrator or, in the absence of a designation by the council, the administrator.
No person shall operate a motor vehicle with a combined weight of vehicle and load greater than 10 tonnes over the speed of sixty (60) kilometers per hour on any road that is under the direction, management and control of the Rural Municipality of Perdue No. 346 (hereinafter referred to as "municipal roads").
This bylaw shall not apply to the operator of a fire engine, fire department apparatus or any other emergency vehicle when on duty.
Signs indicating the maximum speed shall be erected on all major municipal roads.
Voluntary Payment Option
(a) Where the Designated Officer believes that a person has contravened any provision of this Bylaw, the Designated Officer may serve upon such person a Notice of Violation. (b) The Notice of Violation shall be in the form attached as Schedule "A" hereto and include a voluntary payment option that permits the contravening party to pay the following amount, which will be accepted by the Municipality in lieu of prosecution: $100.00
(c) Upon production of the Notice of Violation issued pursuant to the preceding section within thirty (30) days from the date of receipt thereof, together with payment of the specified voluntary fee to the Designated Officer, the person to whom the Notice of Violation was issued shall not be liable for prosecution for the contravention in respect of which the notice was issued.
(d) Where a person contravenes the same provision of this Bylaw two or more times within one twelve-month period, the specified voluntary payment payable in respect of the second or subsequent contravention is double the amount shown in section 5(b) of this Bylaw.

(e) Notices given under this Bylaw shall be served in accordance with section 390 of The Any person who contravenes any of the provisions of this Bylaw is guilty of an offence and liable on summary conviction to the penalties provided in the General Penalty Bylaw of the Rural Municipality of Perdue No. 346.
Bylaw 2-2024 is hereby repealed.
