## Road Restrictions ## RURAL MUNICIPALITY OF PIAPOT NO. 110 ## BYLAW NO 2014-04 ## A BYLAW TO PROVIDE FOR RESTRICTING THE OPERATION OF CERTAIN VEHICLES ON ROADS The Council of the Rural Municipality of Piapot No. 110 in the Province of Saskatchewan enacts as follows: This bylaw shall be referred to as the Road Restrictions Bylaw 1. In this bylaw: - b) "Council" shall mean the council of the municipality; - a) "Administrator" shall mean the administrator of the municipality; - c) "Municipality" shall mean the Rural Municipality of Piapot No.110; - d) "Order" means an order issued by the road committee; - e) "Committee" means a road committee established in accordance with section 81 of The Municipalities Act for the purpose of issuing orders. 2. Council may by resolution establish a road committee for the purpose of issuing orders in accordance with The Municipalities Regulations Part III. 3. The committee shall consist of three members of council and each appointment shall be for a term of one calendar year. 4. The committee may issue an order only if, due to inclement weather or unfavorable road conditions, the use of the road in the manner prohibited by the order would, in the opinion of the road committee reasonably be expected to result in: - a) damage to the road; or - b) a high risk of property damage or personal injury to the public. 5. An order established pursuant to this bylaw may include provisions to: - prohibit the operation of certain vehicles on specified roads and bridges. - restrict the gross weight of vehicles on specified roads and bridges or portions thereof. 6. Subject to the provisions of The Highways and Transportation Act, council may by resolution provide the committee with the authority on behalf of the municipality to opt in or out of the Provincial Road Bans. 7. An order issued under this bylaw must: - b) state the are on which it is sieged and the date on which it takes effect, and (Pl c) be filed with the Administrator - a) be signed by the members of the road committee; 8. Upon receipt of the order the Administrator shall: - a) promptly notify the permit officer in the Department of Highways and Transportation of the issuance or cancellation of any order; and - b) present a copy of the order at the next meeting of council and record so in the minutes 9. Notice of the order shall be posted conspicuously at each end of any applicable road and at any junction or intersection the committee considers advisable. 10. Any order issued pursuant to this bylaw shall be in the form of Schedule "A". 11. An order issued pursuant to this bylaw shall remain in effect until cancellation of the order by the committee and all notices posted in accordance with this bylaw have been removed. 12. This bylaw shall not apply to those vehicles described in Section 3 of The Vehicle Weight and Dimension Regulations, 2010. 13. Any person guilty of any infraction to any of the provisions of this bylaw shall upon summary conviction, be liable to a fine - $100.00 for first offence - $200.00 for second offence 29. $400.00 for third offence - $800.00 for fourth or any successive offence. <!-- image --> For the purpose of determining the amount of the fine under this section, a subsequent offence is deemed to be an offence which occurs within two years of the most recent prior offence. 14. Bylaw #1-2000 is hereby rescinded. <!-- image --> <!-- image --> SPeeper Reeve Yeah Metal Administrator Subsection 8 The Municipalities Act Section 38, The Highways and Transportation Act <!-- image --> Read a third time and adopte his Il day of JUNE 2014 <!-- image --> Administrator <!-- image --> <!-- image --> ## Schedule "A" ## RURAL MUNICIPALITY OF PIAPOT NO. 110 ROAD RESTRICTIONS First Order (number the orders in appropriate sequence) IN ACCORDANCE with Bylaw No. 2014-04 of the Rural Municipality of Piapot No. 110 and with the Municipalities Regulations: Notice is hereby given that effective 12 o'clock midnight, \_ \_and until further notice the following public roadways shall: , and - All municipal highways within the Rural Municipality of Piapot No. 110 will be restricted as follows; Maximum load on steering axles is 10 kg per millimeter (560 Ib. per inch) width of tire (manufacturers' stamped dimensions), to a maximum of 3000 kg (6,612 lb.) on each wheel but to a maximum of 5500 kg (12,120 lb.) on the steering axle; except for straight trucks on primary highways which are allowed up to a maximum of 7250 kg on the steering axle with the appropriate tire size. Maximum loads on all other wheels will be limited to 6.25 kg/mm (350 lb. per inch) width of tire to a maximum loading of 1650 kg per wheel (3,636 lb.) Anyone contravening this order shall be subject to a fine in the amount of: - $100.00 for first offence - $200.00 for second offence - $400.00 for third offence - $800.00 for fourth or any successive offence.
