BYLAW NO. 05/2019
A BYLAW OF THE RURAL MUNICIPALITY OF PLEASANT VALLEY NO. 288 FOR THE PURPOSE
TO REGULATE THE SPEED OF CERTAIN MOTOR VEHICLES
WHEREAS the Council of the Rural Municipality of Pleasant Valley No. 288 in the Province of
Saskatchewan wishes to enact a bylaw to regulate the speed of motor vehicles 10 tonnes and over
on public roadways (excluding hamlets and residential areas otherwise posted) within the Rural
Municipality.
NOW, THEREFORE, the Council of the Rural Municipality of Pleasant Valley No. 288, in the Province
of Saskatchewan, enacts as follows:
1. Short Title
This Bylaw may be referred to as Speed Limit Bylaw.
2. Purpose and Intent
This Bylaw is intended to:
a. Identify areas with the R.M. of Pleasant Valley No. 288 where speed is reduced for motor
vehicles 10 tonnes and over; and
b. set out the penalties and/or fines for those persons who exceed the speed limits on the identified
public highways.
3. Definitions
In this Bylaw:
a. "highway" means any public highway or roadway within the Municipality under the direction,
control and management of the Municipality and "public highway" means a public highway as defined
by The Highways and Transportation Act, 1997;
b. "motor vehicle" means a motor vehicle as defined by or pursuant to The Traffic Safety Act.
4. Provisions
a. No person shall operate a motor vehicle at a speed greater than which is posted on any
highway/roadway.
b. The maximum speed on all roadways within the Rural Municipality of Pleasant Valley No. 288,
excluding Hamlets and residential areas as otherwise posted, shall not exceed 80 km/hr for motor
traffic under 10 tonnes.
c. The maximum speed on all roadways within the Rural Municipality of Pleasant Valley No. 288
shall not exceed 60 km/hr for motor traffic over 10 tonnes, excluding hamlets and residential areas as
otherwise posted, and that these roadways shall be posted as such at the beginning and end of the
restriction.
d. No person shall deface, injure, destroy or remove any speed limit sign or marker erected in
accordance with the provisions of this Bylaw.
5. Enforcement
a. A person who contravenes any provisions of this Bylaw is guilty of an offence and liable on
summary conviction to a penalty of that identified in The Highway and Transportation Act, 1997.
b. Enforcement of this Bylaw may be made by a Bylaw Enforcement Officer and/or Peace Officer
duly appointed for the enforcement of Municipal Bylaws through a resolution of Council.
6. 3. That Bylaw No. 01-2012 hereby be repealed
