## Bylaw No. 11-84 - A BYLAW TO PROVIDE FOR RESTRICTING THE OPERATION OF TRACTORS AND CERTAIN VEHICLES ON ROADS IN THE MUNICIPALITY. The Council of the Rural Municipality of Pleasantdale No. 398 in the Province of Saskatchewan, enacts as follows: 1. by the Minister of Rural Developmenti 2. (a) prohibiting the operation of tractors on any road or raods in the municipality designated by such order; 3. (b) restricting the operation of vehicles, other than tractors, having a gross weight in excess of 2,700 kilograms or such greater weight as the committee may designate; 4. (c) restricting the gross weight that may be transmitted to the road through any point or points of contact of any Vehicle, other than tractors operating on specified roads in the municipality where the the vehicle exceeds 2,700 kilograms; 5. at any time for any period mentioned in such order. 2. The committee may rescind or vary any order under Section 1 within the limits of its authority herein. 3. The provisions of Section 1 shall not apply to any provincial highway as defined in The Highways Act. 4. No person shall operate a tractor or other vehicle in contravention of an order made by a committee pursuant to this bylaw. 5. This bylaw and any order made pursuant thereto shall be subject in all respects to the regulations prescribed by the Minister of Rural Development as set forth in Schedule "A" hereof. 6. No person shall deface, injure, knock down, or remove any notice posted by authority of a committee appointed under this bylaw. 7. Any person found guilty of an infraction of any of the provisions of this bylaw or an order issued pursuant thereto shall be liable to the penalties provided in the General Penalty Bylaw of the municipality. 8. These regulations may be cited as The Road Committee Regulations. 2. In these regulations: 3. (a) "order" means an order issued by the committee; 4. "road committee" means a committee described in paragraph 6 5. of section 222 of The Rural Municipality Act. 3. The resolution establishing a road committee may be passed at any 7. regular or special meeting of the council. 4. A road committee may issue an order only where, due to inclement weather or unfavourable road conditions, the use of the road in the manner prohibited by the order would, in the opinion of the road committee, reasonably be expected to result in damage to the road or result in a high risk of property damage or of personal injury to the public. 9. 5. 10. Every order shall: 11. (a) 12. be signed by the members of the road committee; and 13. state the date on which it is signed and the date on which it takes 14. (b) effect. 15. The road committee shall file every order with the secretary- 6. treasurer , and the secretary-treasurer shall: 17. (a) promptly notify the permit officer in the Department of Highways and Transportation of the issuance of or the cancellation of an order, as the case may be; and 18. (b) present a copy of the order to the next meeting of the council, which presentation shall be recorded in the minutes of that meeting. 19. Upon the issuance of an order, the road committee shall cause a accordance with section 8 to be posted conspicuously at each end of the road to which the order applies and at any junction or intersection of road as the road committee considers 7. advisable. 21. 8. 22. Every notice shall: 23. (a) clearly set out the restrictions specified in the order; 24. (b) state the penalty for violation of the order; 25. (c) 26. be of reasonably durable material; 27. (d) be at least 30 centimetres by 45 centimetres in size; and 28. (e) 29. be placed at least one metre from the ground. 9. (1) The road committee shall cancel an order when the road conditions, in the opinion of the road committee, will withstand the traffic 31. otherwise restricted by the order. 32. Upon the cancellation of an order, the road committee shall cause the notices posted in accordance with these regulations to be removed.
