## RURAL MUNICIPALITY OF PLEASANTDALE NO. 398 ## BYLAW #4-2014 ## A BYLAW TO MANAGE VEHICLE WEIGHTS IN THE HAMLET OF LAC VERT The Council of the Rural Municipality of Pleasantdale No. 398, in the Province of Saskatchewan, enacts as follows: ## PART I - PURPOSE AND DEFINITIONS ## Purpose 1. The purpose of this bylaw is to establish a vehicle weight management system to regulate the weight of vehicles, or vehicles with their loads using any municipal roads located in the Hamlet of Lac Vert located in the municipality. ## Definitions 2. (1) Except as hereinafter provided, words used in this bylaw shall have the meanings ascribed to them in The Vehicle Weight and Dimension Regulations, 2010. - (2) In this bylaw: - b) "Minister" means the member of the Executive Council to whom for the time being the administration of The Highways and Transportation Act, 1997, is assigned; and 4. "Administrator" means the Administrator of the municipality; - c) "Municipality" means the Rural Municipality of Pleasantdale No. 398. ## PART II - VEHICLE WEIGHTS ## Weight Limits on Certain Roads 3. No person shall, without a permit issued: - a) pursuant to section 5 of this bylaw; or - b) by the Minister pursuant to section 36 of The Highways and Transportation Act, 1997 operate or cause to be operated or moved on or over the following municipal highways, as identified in Appendix "A" of this bylaw any vehicle, the gross vehicle weight of which exceeds 8 tonnes (17,600 pounds): 4. ii) William Street, from the most easterly boundary of the unorganized hamlet of Lac Vert to the most westerly part of the intersection with Lakeview Avenue; - i) Lakeview Avenue, from the most southerly part of the intersection with Elsie Street to the most southerly part of the intersection with Cecil Street; 6. iii) All of Cecil Street, John Street, Ross Street, George Street, Howard Street, and Bloomquist Avenue within the boundaries of the unorganized hamlet of Lac Vert; and 7. iv) Elsie Street, from the most easterly boundary of Elsie Street to the most easterly part of the intersection with Lakeview Avenue. ## Exemptions 4. This bylaw does not apply to the following vehicles: - (2) motor graders, pavement-striping equipment, or snow removal equipment operated by or on behalf of the Ministry of Highways or the municipality; - (1) road construction and maintenance equipment moving on or over any roadway within the hamlet of Lac Vert within the limits of the project on which they are being used; - (3) emergency vehicles; - (4) commercial vehicles providing services to residents of the hamlet of Lac Vert, including fuel and septic. ## Permits 5. (1) Permits shall be issued using Form A, attached hereto forming a part of this bylaw. - (2) The Administrator shall, upon approval of Council, provide permits (no term restrictions) for secondary weights upon request of occupants residing on the weight restricted roads and requiring secondary weight vehicular access. - (3) Notwithstanding section 3 of this bylaw, the Administrator shall, upon the approval of Council if satisfied that the vehicle or combination of vehicles can be operated or moved upon the municipal highways identified in section 3 of this bylaw, without damage to the highway or other property, issue a permit to the registered owner of the vehicle or combination of vehicles to exceed the maximum gross vehicle weights fixed by this bylaw. - (4) No permit fees will be charged. ## PART III - ENFORCEMENT ## Penalty 6.
