## RURAL MUNICIPALITY OF RENO NO. 51 ## BYLAW 203/07 ## A BYLAW TO PROVIDE FOR THE RESTRICTING THE OPERATION OF CERTAIN VEHICLES ON ROADS The Council of the Rural Municipality of Reno No. 51 in the Province of Saskatchewan enacts as follows: This bylaw shall be referred to as the Road Restrictions Bylaw ## PART I - PURPOSE AND DEFINITIONS The purpose of this bylaw is to establish a vehicle weight management System to regulate the weight of vehicles, or vehicles with their loads, using the route within the Municipality commonly know as the Spangler Road Located S ½ of 04-02-29w3, S ½ of 05-02-29 w3, N ½ 33-01-29 w3, N ½ 32-01-29 w3, S.E. of 06-02-29 w3, N ½ 06-02-29 w3, Parts W ½ 07-02-29 w3, E ½ 12-02-30 w3, SW 18-02-29 w3 and SE 13-02-30 w3. ## PART II - BYLAW 1. In this bylaw: - d) "Order" means and order issued by the road committee; - e) "Committee" means a road committee established in accordance with Section 81 of The Municipalities Act for the purpose of issuing orders. 2. Council may be resolution establish a road committee for the purpose of issuing orders in accordance with The Municipalities Regulations Part III. 3. The committee shall consist of 4 members of council and each appointment shall be for a term of one year. 4. The committee may issue an order only if, due to inclement weather or unfavorable Road conditions, the use of the road in the manner prohibited by the order would, In the opinion of the road committee reasonably by expected to result in: - a) damage to the road; or - b) a high risk of property damage or personal injury to the public. 5. a) No person shall, without a permit issued pursuant to this bylaw operate or move or cause to be operated or moved on or over the road, a vehicle witl their load in excess of 8000 Kilograms (17,600 pounds.) The Maximun gross weight on any axle not to exceed 6000 Kilograms (13,200 pounds.) - b) This restriction applies to all vehicles except those listed below - All farm equipment vehicles, including tractors, combines, sprayers, swathers, and balers and hay operating and hauling - Emergency Vehicles - Fuel or propane trucks, municipal equipment and contracting - Any vehicle being towed by a truck or car by means of a threepoint hitch(including trailers, flat decks, stock trailers, wagons, tanks) shall be considered as separate units for complying with weight restriction limits imposed by order of the road committee. 6. Subject to the provisions of The Highways and Transportation Act, council may by resolution province the committee with the authority on behalf of the municipality to opt in or out of the Provincial Road Bans. 7. An order issued under this bylaw must: - b) state the date on which it is signed and the date on which it takes effect; and - a) be signed by the members of the road committee; - c) be filed with the Administrator 8. Upon receipt of the order the Administrator shall: - a) promptly notify the permit officer in the Department of Highways and b) praspotaipy ofthe orderace or neelating of couri and record so 9. Notice of the order shall be posted conspicuously at each end of any 10. Any order issued pursuant to this bylaw shall be in the form of Schedule "A". 11. Any order issued pursuant to this bylaw shall remain in effect until cancellation of the order by the committee and all notices posted in accordance with this bylaw have been removed. ## PART III - VEHICLE WEIGHTS ## Weight Limits on Certain Roads 1. a) No person shall, without a permit issued pursuant to this bylaw operate or move or cause to be operated or moved on or over the road, a vehicle with their load in excess of 8000 Kilograms (17,600 pounds.) Municipal Overweight Transportation Permits may be issued by the administrator, or any designated signing authority of the municipality as appointed by resolution of Council, and at the discretion of that signing authority, for the purpose of exempting a vehicle from the restrictions specified in an order, under the following conditions: - b) A blanket permit will be available to all persons who actively farm along have no alternate route to access their farmland, for the purpose of exemption from a weight restriction order. - a) A Blanket permit will be available to all ratepayers living along the Spangler Road, which is subject to an order of the road committee, and who have no alternate access from their yard sites, for the purpose of exemption from a weight restriction order. - c) The blanket permits specified in Clause 2. (a) &amp; (b) will be specific for each licensed vehicle owned or operated by the ratepayer, and should be retained in the vehicle. - d) There will be no fee charged for a permit issued under the authority of Clauses 2. (a), (b) &amp; (c) - a) Specific permits may be issued to anyone making a reasonable request, and at the discretion of the signing authority, to temporally exempt a vehicle from an order issued by the road committee. 3. - b) Permits issued under the authority of Clause 3. (a) will be specific for one licensed vehicle, and should be retained in the vehicle; and may be limited to one specific purpose, or to an extended period of time as the situation warrants, and according to the discretion of the signing authority. - c) For permits issued under the authority of Clause 3. (a) and (b) there will be a fee of Fifty dollars per permit. 4. All overweight permits issued under Clause 2. and 3. will be written under the conditions that maximum weight cannot exceed the legal prescribed limits established by Saskatchewan Highways and Transportation for secondary highways, and as per any current restriction order that may be in effect for the applicable Zone for this municipality. 5. All overweight permits issued under Clause 2 and 3 will be written to apply to the shortest possible route on the Spangler Road. 6. All Spangler Road Overweight Transportation Permits will be issued in written form only, and will not be valid by verbal consent. 7. There shall be no Road Restrictions effective November 1 to April 1 of each year. 8.
