1 RURAL MUNICIPALITY OF SHERWOOD NO. 159 BYLAW NO. 10/15 A BYLAW TO REGULATE THE USE OF STREETS AND ROADS Whereas pursuant to clauses 8(1)(f) and (g) of The Municipalities Act, a council of a rural municipality is authorized to make bylaws, subject to The Highway Traffic Act, relating to the use of vehicles and the regulation of pedestrians and in relation to streets and roads; and Whereas it is necessary and advisable to enact a bylaw to regulate streets and roads and to provide for the safe operation and travel of all vehicles within the rural municipality; NOW THEREFORE the Council of the Rural Municipality of Sherwood No. 159, in the Province of Saskatchewan, enacts as follows: Title 1. This Bylaw may be referred to as the Traffic Bylaw. Definitions 2. In this bylaw: (a) "highway" means a road allowance, road, street or public highway as defined in The Highways and Transportation Act, 1997, that is under the direction, control and management of the municipality, and includes the shoulder of the roadway; (b) "motor vehicle" means a motor vehicle as defined in section 2 of The Traffic Safety Act; (c) "park" means the standing of a vehicle, whether occupied or not, on a highway, otherwise than temporarily for the purpose of and while actually engaged in loading or unloading, or in obedience to traffic regulations, traffic signs or signals, or the direction of a traffic officer or constable; (d) "vehicle" includes a vehicle, trailer, semi-trailer or motor vehicle. Parking prohibited 3. No person shall park a vehicle on any highway. Speed limits 4. No person shall operate a vehicle on a highway at a speed greater than: (a) 80 kilometres per hour; or (b) the maximum speed indicated by any signs that are erected on the highway by the municipality. Signs 5. No person shall deface, injure, destroy or remove any sign or marker erected by the municipality for the purposes of this Bylaw. Tarp required 6. No person shall transport any materials of any kind in an open box of a vehicle unless the box is covered with a securely fastened cover to prevent materials from blowing out or otherwise escaping from the box. Encumbrances on highways and public places 7. (1) Unless authorized by council, no person shall: (a) dig holes in any highway or road allowance or remove any earth, gravel or asphalt from any highway, road allowance or property owned by the municipality; or (b) subject to subsection (2), operate or permit any farm implement or thing whatsoever to be operated on the side slope or the top of the grade of any highway so as to in any way injure the surface. (2) Adjacent farmers may extend their regular farm land cultivation on to the road allowance, where it is practical to do so, but only to the side slope of the road. 2 (3) No person shall place or deposit any earth, snow or ice, stones, rubbish, sewage, dead animals, junked or abandoned vehicles or any other object or substance that may in any way hinder either the maintenance of or the public's right of passage over a highway or other public place in the municipality. (4) No person shall erect a fence, gate, sign or other structure or plant any trees or other vegetation: (a) on any part of a highway or road allowance or on property owned by the municipality; or (b) within the area of a right-angled triangle formed at the intersection of two roadways, where the legs of the triangle extend 140 metres from the mid-point of the intersection. (5) A person designated by Council may remove and dispose of any object, substance, structure or other encumbrance that is placed, deposited or erected contrary to this section. (6) A person who is convicted of a contravention of this section is required to remove the encumbrance within 48 hours of the conviction, if it has not already been removed pursuant to subsection (5), failing which a person designated by the council may remove and dispose of it. (7) Where a person is convicted of a contravention of this section and a person designated by Council has removed the encumbrance pursuant to subsection (5) or (6), the municipality may charge the expense of doing so to that person. Snow ridges and snow fences 8. A person designated by Council shall notify the landowner where practical and may enter on land adjoining any highway or road allowance for the purpose of making snow ridges or erecting snow fences as a measure to prevent the blocking of highways by snow drifts. Certain vehicles prohibited 9. No person shall operate or move upon or over a paved road any vehicle or equipment having metal cleats, metal tracks, tire chains or any other metal device attached to or forming part of the wheels. This does not apply to vehicles with studded winter tires. Certain bylaws repealed 10. The following bylaws are repealed: (a) Bylaw No. 122, A Bylaw of the Rural Municipality of Sherwood No. 159 of Saskatchewan relating to the planting of trees or shrubs or the placing of stone, earth or gravel piles and other objects adjacent to certain highways; (b) Bylaw No. 4-73-4, A Bylaw to Compel the removal of Dirt, Stones, Filth or Rubbish from Public Places; (c) Bylaw No. 10-73-10, A Bylaw respecting Ploughing, Encumbering and Obstructing Roads; (d) Bylaw No. 2-83, A Bylaw to regulate the parking of motor vehicles in the Rural Municipality of Sherwood No. 159; (e) Bylaw No. 2-92, A Bylaw of the Rural Municipality of Sherwood No. 159 to provide for snow ridges and snow fences; (f) Bylaw No. 01-05, A Bylaw to Compel the Removal of Encumbrances off Municipal Roads or other Public Places; (g) Bylaw No. 01-12, A Bylaw to Regulate Weights and Road Restrictions for Vehicles Operating Within the Rural Municipality of Sherwood No. 159; and (h) Bylaw No. 11-12, A Bylaw for the Purpose to Regulate the Speed of Motor Vehicles. Coming into force 11.
