TOWN OF SALTCOATS Bylaw No. 01-2025 A BYLAW OF THE TOWN OF SALTCOATS IN THE PROVINCE OF SASKATCHEWAN TO REGULATE TRAFFIC IN THE TOWN OF SALTCOATS. THE COUNCIL OF THE TOWN OF SALTCATS ENACTS AS FOLLOWS: 1. (1) In this Bylaw, unless the context otherwise requires the expressions: A) "COUNCIL" shall mean the Council of the Town of Saltcoats. B) "CURB" shall mean the actual curb and if there be no curb in existence, shall mean the dividing line between that part of a public highway intended for the use of vehicles and that part of a public highway intended for use by pedestrians. C) "INTERSECTION", means the area embraced within the prolongation of a lateral curb line, or if none, then the lateral boundary lines of the two or more streets or highways which join one another or an angle whether or not one such street or highway crosses the other. D) "LANE" shall mean that kind or type of a public highway intended primarily to give access to the rear of real property and intended primarily for the use of vehicles. E) "MOTOR VEHICLE", "OPERATOR", "OWNER", "PARKING", "PUBLIC HIGHWAY", "STOP", "TRAFFIC LANE", "VEHICLE", "LOADED TRUCK", "NIGHT", "GROSS WEIGHT", "WHEEL BASE", "TRAILER" shall have the meaning given to them in the Vehicles Acts, R.S.S. 1965 Chapter 377 and amendments thereto. F) "PARADE" shall mean any group of pedestrians marching or walking along a public highway and numbering (twelve or more), or any group of vehicles (numbering ten or more) and proceeding on a highway under a common leadership, except funeral processions. G) "PEDESTRIAN" means any person on foot, and shall include baby carriage or wheelchair. H) "POLICE OFFICER" means a member of the Royal Canadian Mounted Police. I) "PRIVATE DRIVEWAY" means the road of driveway not open for the use of the public for the purpose of vehicles or traffic. 2 J) "SIDEWALK" means that potion of the street set aside for the exclusive use of pedestrians. K) "TOWN" shall mean the Town of Saltcoats. L) "TRAFFIC" shall mean the movement of pedestrians, vehicles or livestock upon any public highway in the Town. (2) Whenever in this Bylaw the expression vehicle, vehicular and vehicular traffic is used, it shall mean and be held and include for the purpose of prosecution under this Bylaw, the driver or operator. 2. EMERGENCY CONTROL MEASURE: A) A police officer is hereby authorized to direct traffic in conformity with the provisions of the Bylaw and the Vehicles Act. B) In the case of fire or other emergency, or in order to expedite traffic, or safeguard pedestrians or prevent accidents or meet any unforeseen conditions, a police officer is hereby authorized to direct traffic in such a manner as he may deem necessary whether or not in conformity with the conditions of this Bylaw or the Vehicle Act. C) Every person shall comply with any traffic signal or direction of a police officer, given pursuant to this section. 3. AUTHORITY TO ERECT SIGNS The Council may authorize the erection or maintaining on any public highway in the Town any warning or direction sign, marker, signal or light for the direction of traffic. 4. PROTECTION OF SIGNS No person shall, deface, injure, knock down, remove, obscure, or interfere with any warning, or direction sign, marker, signal or light erected or maintained by the authority of the Council 5. USE OF SIGNS FORBIDDEN No person, unless authorized by the Council, except a police officer herein provided, shall erect or maintain on any public highway or adjacent to the public highway in the Town, any warning or direction sign, marker, signal or light. 6. TEMPORARY CLOSING AND PARKING A) Any portion of a public highway maybe temporarily closed to vehicular traffic by the Council or the Administrator in order that the pedestrian may have the exclusive use thereof. 3 B) Notwithstanding any other provisions of this Bylaw a police officer shall have authority to temporarily prevent parking on any public highway or portion thereof whenever in his judgment it may be necessary in order to avoid traffic congestion, danger or accident. C) Notwithstanding any other provisions of the Bylaw the Council may appoint a person who shall have the authority to temporarily prevent parking and/or prohibit traffic on any public highway or portion thereof to allow any work to be carried out on or behalf by the Town, such work to include but not be restricted to snow removal, cleaning, repairing or maintenance of such pubic highway. 7. STREETS PROHIBITED TO TRAFFIC A) No person driving a vehicle shall drive through or enter upon any street or portion thereof which is roped, barricaded or indicated by notice or sign as being closed under authority of a police officer or the Council. B) No person shall park a vehicle on any public highway or portion thereof on which parking has been temporarily prohibited by a police officer or the Council. 8. OBSTRUCTING TRAFFIC No pedestrian or driver of a vehicle whether making deliveries from the vehicle or not, shall obstruct the free passage of traffic on any street, lane or sidewalk. 9. SPEED LIMIT A) Subject to the Vehicles Act, the maximum speed shall be forty (40) kilometres per hour on all streets within the town limits, except as relates to the school zone(s); B) Thirty (30) kilometers per hour in school zones during the hours of 8 a.m. to 8 p.m. every day; C) Provided further that any Provincial Highway which runs through the Town of Saltcoats be excluded from this section of this Bylaw; D) Notwithstanding any other provisions of this Bylaw, this section shall not apply to a police officer when engaged in the performance of his duties or a fire engine and fire equipment apparatus proceeding to, and from, a fire. 10. STOP AT CURB Every driver of a vehicle shall draw up to the right hand curb before stopping unless such stop be necessary to avoid collision or for the purposes of immediately reversing the vehicle to place it at the curb. 11. LEAVING STATIONERY POSITIONS 4 An operator of a vehicle in turning out from a stationery position at the side of a public highway or from the curb shall yield the right of way to all traffic, and shall not proceed until it is safe to do so. 12. PARKING A) All vehicles will park on the right side of the street, parallel to the sidewalk as close to the sidewalk as possible, and not closer than three (3) feet from any other vehicle on all streets in the Town of Saltcoats. with the exception of the following designated areas: where all vehicles will park on the right hand side of the street at a forty-five (45) degree angle to the sidewalk, front of the vehicle facing in, bumper to the curb but shall not exceed over the curb. i) The easterly side of High Street between Commercial Street and Lot 14, Block 3, Plan 4383 (up to land used as a backlane); and ii) The east side of Lot 15, Block 10, Plan 4383 (located facing Glasgow Avenue) with a vehicle length restriction as specified in Section "B"; iii) The East side of Lots 8, 9, and 10, Block 10, Plan 4383 (located facing Glasgow Avenue) with a vehicle length restriction as specified in Section "B". B) No vehicle having an overall length of more than twenty-four (24) feet will park in these areas designated for angle parking with the area described as the east side of Lot 15, Block 10, Plan 4383 having the further restriction that only cars are permitted. C) No operator of a vehicle shall park any vehicle on any one parking space on any street continuously for any period exceeding seventy-two (72) hours. D) No person shall park upon a street, any vehicle displayed for sale. E) No person shall park any vehicle on any of the following places i) in any lane. ii) in front of a private driveway. iii) within an intersection. iv) on a cross walk. v) on a sidewalk. vi) within ten feet of yellow corners at intersections. vii) within fifteen feet of the driveway entrance to any fire station viii) within five feet of the entrance to any lane. ix) within fifteen feet of the entrance to a fire reservoir or hydrant. x) double park on any street within the town. xi) in any "Loading Zone", except for the purchase of taking on or discharging cargo, and, further that such taking on or discharging must be confirmed to a period not exceeding thirty (30) minutes at one time, unless written permission 5 has first been obtained from the administrator of the municipality for an extension of such time. xii) on the travelled portion of any street. F) No operator of a vehicle shall park any vehicle at any place where traffic signs have been placed prohibiting such parking. G) No person shall park a vehicle having three (3) or more axles except on private land where owner's permission has been obtained and in the designated semi parking area as signed and contained in Parcel BB, Plan 101781671, Ext. 4 and Parcel BC, Plan 101781660, Ext. 3 (area across from Lots 4-14, Block 3, Plan 4383) within the Town limits, with the exception that in cold weather, the tractor portion only of a semi unit may be parked at a residence or other source of power where permission has been obtained. H) No person shall park or leave standing a vehicle not licenced for the current year on any street, land or public parking lot. 13. SNOWMOBILES/ALL-TERRAIN VEHICLES A) Under the provisions of the Snowmobile Act, it shall be lawful to operate a licenced snowmobile on any street or land but only for the purpose of operating the snowmobile from a point of origin within the corporate boundaries of the Town of Saltcoats to a point outside the said corporate boundaries and to return to the point of origin within the corporate limits of the Town of Saltcoats by the most direct and practical route possible between the exit/entry points and the point of origin, utilizing lanes wherever possible and practical. B) No one shall operate a snowmobile within the limits of the Town of Saltcoats without a valid driver's licence as per provincial legislation. All snowmobiles operated outside of private property within the limits of the Town of Saltcoats must be registered and plated as per provincial legislation. All personal and public liability will be the responsibility of the operator of the snowmobile. C) Operators shall not cross Provincial Highway No. 16 except at an existing public road approach and in the manner described in the Snowmobile Act, section 21(3). D) If a snowmobile club wishes to designate a trail within the corporate limits of the Town of Saltcoats, the club shall: i) Become a member of the Saskatchewan Snowmobile Association; ii) Be responsible for appropriate signing and grooming; iii) Obtain the required permits from regulatory agencies, including but not limited to the Department of Highways and Transportation. E) As per The All Terrain Vehicles Act, the operation of all-terrain vehicles is prohibited on the travelled portion of any street in the municipality; the operation of such vehicles on the untraveled portion of any street is lawful but only for the purpose of 6 operating the all-terrain vehicle from a point of origin within the corporate boundaries of the Town of Saltcoats to a point outside the said corporate boundaries and to return to the point of origin within the corporate limits of the Town of Saltcoats by the most direct and practical route possible between the exit/entry points and the point of origin, utilizing lanes wherever possible and practical. 14. TOWING No driver of a motor vehicle shall tow more than one other vehicle at a time. 15. NO SPLASHING OF PEDESTRIANS When water, mud or slush is lying on any public highway, the driver of every motor vehicle around shall reduce the speed of his vehicle to avoid splashing pedestrians using a sidewalk or normal area for waking. 16. NO HITCH-HIKING No person standing or walking on a street shall solicit a ride by word or any action whatsoever, from the driver of a moving vehicle. 17. U-TURNS A) No person shall make a U-Turn on any street other than at an intersection. B) No person riding a vehicle shall make a U-Turn at any of the following intersections. i) Any intersection at the time when the movement of traffic thereon is being controlled or directed by a police officer or traffic signal lights. ii) Any intersection at which a traffic sign has been erected and is being maintained, bearing the words "NO-U-TURN" or words to that effect, provided that this clause shall be deemed to apply to traffic approaching an intersection from the direction in which the said sign faces. 18. INTERSECTIONS AND BRIDGE STOPS No driver of a vehicle shall stop same within any highway intersection except to avoid an accident, nor stop same on a bridge except in the case of emergency. 19. SPACE BETWEEN MOVING VEHICLES Every person driving a vehicle behind another moving vehicle or vehicles shall preserve a sufficient interval to be able to stop without accident in the event of an emergency stop on the part of the leading vehicle. 20. MUST STOP ENGINE A) No driver shall park a motor vehicle on any public highway with the engine running 7 unless the vehicle remains in charge or under control of the driver. B) Any vehicle may be parked with the emergency brake set and with the engine running when such vehicle is equipped with an automatic starting devise which will operate only when the vehicle is in neutral gear, and provided a notice is so placed on the vehicle in such a position as to be plainly visible to members of the Police Department. 21. BACKING A VEHICLE No driver of a vehicle shall back same around the corner of a lane or highway intersection. 22. VEHICLES ON SIDEWALKS A) No person shall drive a motor vehicle on to or across any sidewalk at any point other than a sidewalk crossing. B) No driver of a vehicle shall permit same to stand on any sidewalk crossing so as to obstruct the crossing. C) Notwithstanding anything to the contrary, a person may obtain the written permission of the Town Administrator when the said administrator is satisfied that due precautions have been or will be taken by the applicant to protect sidewalks from injury and that the use thereof for such purpose will not cause any unwarranted obstruction to the pedestrian to cross with a vehicle other than a regular crossing place. The owner, driver or operator who has obtained a permit as mentioned herein is none the less responsible for all damage that may be caused to the sidewalk for reasons of the driving, operating or moving of the vehicle. The applicant who has received permission from the Town Administrator, may cross over the sidewalk if the sidewalk is covered with a planking at least one and a half inches in thickness, securely fastened or clamped and beveled off at the end so as not to cause obstruction to pedestrians, and constructs across the drain, gutter or water course opposite the proposed crossing, a good and sufficient bridge or planks or other proper and sufficient material so constructed as not to obstruct the said drain, gutter or water course. 23. LITTER No person shall throw or deposit from any vehicle upon any street or sidewalk anything that will injure or litter same or cause any obstruction or nuisance to traffic and pedestrians. 24. UNNECESSARY NOISE A) No person by use of any mechanical devises on a vehicle shall, while operating a vehicle within the Town of Saltcoats, make any unusual, unnecessary, or unreasonable noise, except given a license to do so by the Town. B) For the purpose of subsection (a) preceding, and without limiting or restricting the generality of said subsection (a) preceding, unusual, unnecessary and/or unreasonable 8 noise shall be deemed to include the noise caused by the screeching of tires, backfiring or motors, and sounding of horns. C) No person shall operate a vehicle on any public highway at any time in the Town of Saltcoats in such a manner as to cause the rear wheels of the vehicle to spin whereby foreign objects are thrown from, or by, the wheels of the vehicle. 25. BICYCLES A) No person riding on a bicycles designed for carrying one person shall carry any other person thereon and at no time shall any bicycle carry more persons than there are seats properly attached to the said bicycle. B) No person shall ride a bicycle on the sidewalks of Town. C) No person shall drive a motorcycle or a Bicycle without at least one hand on the handle bars. D) No person shall ride a bicycle on a street on the left side of any two other persons riding abreast on that street except for the purpose of passing. E) No person shall leave a bicycle in a reclining position on a street; on those streets in which there is a curb, bicycles when left at the curb shall be left in an upright position, or placed in a bicycle rack if one is present. 26. PARADES No parade shall be held in the Town without the written permission first and obtained from the administrator who shall designate or approve the hour and route of the parade. Any person desiring to hold a parade shall apply to the Administrator in writing for a permit therefore not less than forty-eight (48) hours before the time set for the commencement of the parade and shall give full particulars thereof. 27. HEDGES AND TREES The Town of Saltcoats shall have the authority to determine if a hedge, shrub or tree situated at an intersection is dangerous to traffic and shall pass a resolution ordering that such hedge, shrub or tree be removed or lopped to such a height as maybe required. 28. SCHOOL BUS FLASHING LIGHTS The Operator of a school bus when operating a school bus on public highways within the municipality shall: A) Activate the flashing signals when stopped for the purpose of loading and unloading school children, at least three hundred and fifty (350) feet or at least one hundred (100) meters before the point of loading and unloading; B) Maintain the operation of flashing signals while stopped to load or unload school children; 9 C) When unloading school children, discontinue the operation of the flashing signals after the school children have reached a place of safety before continuing along the public highway. 29. TRUCK ROUTES & RESTRICTIONS A) The routes shown on the map appended to the Bylaw as Schedule "A" are designated as truck routes. B) No person shall drive or park a heavy vehicle on any highway not designated as a truck route, except: i) Where the owner or operator of the vehicle has obtained a permit to do so from Council or the Town Office; ii) Permits will not be issued if Rural Municipality Road Bans are in effect; iii) To pickup or deliver cargo transported by the vehicle, in which case the vehicle must follow the most direct route to and from the truck route. C) Exemptions from the bylaw are as follows: i) Emergency Vehicles and Equipment ii) Public Works Vehicles and Equipment iii) Saltcoats School buses iv) Sanitation Vehicles v) Vehicles servicing the Town of Saltcoats Maintenance 30. ALL TO COMPLY A) The owner of a motor vehicle, tractor, or trailer, other than a public service vehicle, is liable for violation of any provision of this Bylaw in connection with the operation of the motor vehicle, tractor or trailer, unless he proves to the satisfaction of the Provincial Magistrate or Justice of the Peace trying the case that at the time of the offense the vehicle, tractor or trailer was not being operated by him, nor by any other person with his consent, express or implied. B) Where, at the time of a violation of any provision of this Bylaw in connection with the operation of a motor vehicle, other than a public service vehicle, the vehicle was not being operated by the owner of the vehicle, nor by any other person with his consent, express or implied, the person in charge of the vehicle is liable for the violation unless he proves to the satisfaction of the Provincial Magistrate or Justice of the Peace trying the case that the vehicle was not being operated by him, nor by any other person with his consent, express or implied. C) A person who contravenes any of the provisions of this Bylaw or fails to comply 10 therewith or with any notice given there under shall be guilty of an infraction of this Bylaw and be liable to the penalty as here underprovided. 31. PENALTIES A) A person who is guilty of a violation of any of the provisions of Section Twenty-five (25) of this Bylaw shall forfeit their bicycle to the Town for a period of forty-eight (48) hours, or longer at the discretion of Council or its designate. B) Any person who contravenes the provisions of this Bylaw is guilty of an offense and upon summary conviction shall be liable to the following penalty: First Offence: $100.00 Second Offence: $200.00 (Any subsequent offences within twelve (12) months of the first offence.) 32. PAYMENT OF FEES A) Where a person has committed or is alleged to have committed a breach of any of the Sections of this Bylaw, specified in subsection (B) of Section 29 hereof, a notice in the form to be approved by the Town Council may be given to such person requiring them to appear at the Town Office within seven days of the date of such notice and to pay to the Town Administrator an amount equal to the fine fixed in lawful money of Canada as a penalty for the specific infraction described in such notice. B) Compliance with such notice within the period of time prescribed therein shall relieve such person from liability to prosecution in respect of such infraction. C) Service of such notice may be made by attaching same to the vehicle in respect of which an offence has been committed or by mailing such notice addressed to the registered owner of the vehicle concerned, or by personal service on the person who has committed the offence. D) If the person given such notice fails to pay the specified fine within the time allowed then the provisions of this section shall no longer apply and the person shall be liable on summary conviction to the penalties imposed in the General Penalty Bylaw of the Town of Saltcoats, provided that nothing in this section shall prevent any person served with such notice from exercising his rights to defend any of these particularized offences. 33.
