INTERPRETATION - (a) "angle parking" means the parking of vehicles with the right front wheel drawn up to the curb on the right-hand side of the highway, or at a distance of not more than thirty (30) centimetres from such curb, the vehicle to be placed at an angle of forty-five (45) degrees with the curb. - (b) "CAO" means the Chief Administrative Officer of the Town of Shaunavon. - (c) "curb" means the lateral boundaries of a roadway, whether or not marked by curbing. - (d) "council" means the council of the Town of Shaunavon. - (e) "heavy vehicle" means a vehicle with or without load which alone or together with any trailer, semi-trailer or other vehicle being towed, weighs 4.5 tonnes or more. - (f) "highway" means a roadway, parkway, driveway, square or place designed and intended for or used by the general public for the passage of vehicles, but does not include any area. whether privately or publicly owned, that is primarily intended to be used for the parking of vehicles and the necessary passageways on that area and does not include a provincial highway within the municipality as designated pursuant to the provisions of The Highways and Transportation - (g) "justice" means a justice of the peace as per The Interpretation Act, 1995 - (h) "loading zone" means that portion of a public highway adjacent to the curb designated by signs and/or markings for the exclusive use of vehicles loading or unloading passengers or goods. - "lug vehicle" means any vehicle, portable engine or traction engine having metal spikes. lugs or cleats projecting from the face of the wheels or tires thereof, or having metal track - (i) "municipality" means the Town of Shaunavon. - (k) "parade" shall mean any group of pedestrians marching or walking on the highway and numbering twenty - five (25) or more (except the militia or any unit of Her Majesty's Forces) and any group of vehicles numbering ten (10) or more and proceeding under a common leadership, except funeral processions. - "parallel parking" means the parking of a vehicle with both right wheels thereof drawn up to the curb on the right-hand side of the highway, or at a distance of not more than thirty (30) centimetres from such curb. - (m) "park" and "parking" have the meanings ascribed thereto by The Traffic Safety Act. - 'n) "place of public assembly" means schools, theatres, moving picture theatres, churches. hockey rinks, curling rinks, dance halls and public assembly halls - (o) "pedestrian crosswalk" means: - i) that portion of a highway designated by signs and/or markings for the use of pedestrians to cross a highway; - ii) where there are no signs, markings or flashing signal, that portion of a highway within the prolongation of the lateral boundary lines of the adjacent or intersection sidewalks at the end of a block; <!-- image --> - iii) where this is no sign, marking, sidewalk or flashing signal, that portion of the highway measured five (5) metres back from the intersection and parallel across the roadway. - (p) "power turn" means to maneuver a vehicle in such a manner to cause part of the vehicle to depart from its ordinary line of progress by the sudden use of acceleration and/or braking. - (9) "special constable" means the Royal Canadian Mounted Police or a person appointed to enforce municipal bylaws. - (r) "speed bump" means an uneven patch on the highway constructed of asphalt. concrete or other like material for the purpose of controlling speed. - (s) "speed zone" means any portion of a highway within the Town of Shaunavon, as designated herein, and identified by a sign erected and maintained at each end thereof, indicating the maximum speed applicable. - (t) "stop" means: - i) when required, a complete cessation from movement; or - ii) when prohibited, any stopping, even momentarily, of a vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic control signal - (v) "U-turn" means the turning of a vehicle so as to cause it to proceed in the opposite direction from which it was proceeding immediately prior to the commencement of such turn - (W) "vehicle" means a vehicle, trailer, or semi-trailer or a motor vehicle as ascribed to it by The Traffic Safety Act. ## 2. SCOPE - (a) "STOP" STREETS The streets and avenues listed in APPENDIX I are designated as "Stop" streets. - (b) "YIELD" STREETS The streets and avenues listed in APPENDIX 2 are designated as "Yield" streets. - (c) "NO U-TURN" INTERSECTIONS The intersections of streets and avenues listed in APPENDIX 3 are designated as "No U-Turn" intersections. - (d) "LOADING ZONES" The highway locations listed in APPENDIX 4 are designated as "Loading Zones". - (e) "NO THROUGH ROAD" The intersections listed in APPENDIX 5 are designated as "No Through Road". ## 3. INFRACTIONS - (a) "STOP" STREETS The provisions of The Traffic Safety Act shall apply to all traffic approaching and facing a "Stop" sign erected and maintained in accordance with the provisions of Section 4. (a). - (b) "YIELD" STREETS - The provisions of The Traffic Safety Act shall apply to all traffic approaching and facing a "Yield" sign erected and maintained in accordance with the provisions of Section 4. (b). - (c) MISCELLANEOUS SIGNS - (1) No person shall, except where authorized by resolution of council or when duly authorized by law, erect upon or immediately adjacent to any highway, any sign, marker, signal or light or any advertising sign or device. - (2) No person shall deface, damage, destroy or remove any sign or marker erected pursuant to this bylaw. <!-- image --> ## (d) SCHOOL BUS FLASHING LIGHTS - (1) Subject to subsection (2) the operator of a school bus when operating a school bus on public highways in the Town of Shaunavon shall not activate the safety lights. - (2) The provisions of subsection (1) shall not apply to Provincial Highways No. 13 and 37 nor Tenth Avenue within the limits of the municipality. 3. (e) SCHOOL CROSSING GUARD The driver of a vehicle shall bring the vehicle to a stop when directed to do so by a schooi crossing guard patrolling a crosswalk. ## (f) LUG VEHICLES - (1) No person shall propel, operate or drive any lug vehicle upon any highway within the Town of Shaunavon without first having obtained from the CAO a permit in writing authorizing same. - (2) The CAO is hereby authorized to issue permits in writing for the purpose of Section 3. (f)(1) of this bylaw in any case where the applicant therefore has signed a written undertaking in Form 1, APPENDIX 6. Provided that the CAO shall not issue any such permit unless he is satisfied that with reasonable care in operation the lug vehicle may be propelled or driven over any highway without damage resulting thereto or to any bridge or culvert thereon. - (3) Nothing contained in subsection (f)(1) shall be deemed to preclude the transport of any lug vehicle as herein defined over any highway where same is being carried by means of a rubber-tired trailer or other conveyance equipped with rubber tires. ## (g) PARKING - (1) Except as otherwise provided herein, the parking of vehicles is permitted on all highways within the municipality. - (2) (i) subject to the provisions of subsection (il), no person shall park a vehicle in any lane, nor in any street so as to obstruct the entrance to any lane or to a driveway or approach leading to private premises; 3. (ii) notwithstanding the provisions of subsection (i), a vehicle may be parked in any lane for the purpose of taking on or discharging cargo, provided no such rehicle shall be so parked for a period exceeding thirty (30) minutes at one time, unless written permission has first been obtained from the CAO or a police officer of the municipality for an extension of such time limit. - (3) (i) Except as provided for in subsection 3. (g) (3) (iii); every person parking a vehicle upon a highway within the municipality where parking is permitted shall parallel park same; 5. (ii) No person shall park a vehicle facing the opposite direction of the flow of traffic; 6. every person parking a vehicle upon the highways listed in APPENDIX 7 shall angle park same. - (4) No person shall park a vehicle in any "No Parking" area as designated in APPENDIX 8. - (5) No person shall park a vehicle within five (5) metres of any street intersection or fire hydrant. - (6) Timelines for Parking - i) Subject to Sub-section (ii); No person shall park a vehicle on any highway at one place for any period of time exceeding seventy-two (72) consecutive 11. ii) Council may authorize permits be issued to allow for temporary parking of trailers, dumpsters, etc.to allow for construction or extensive renovation projects that require more than seventy-two (72) hours to complete. - (7) No person shall park any vehicle in any private parking place or on any private property unless he is the owner, occupant, licensee or permittee of the parking olace or private property, except with the consent of such owner, occupant, licensee or permittee. 4 Kl <!-- image --> - (8) (1) subject to section (ii), no person shall park any commercial vehicle designed for carrying or intended for the carrying of oil, gasoline or other inflammable, combustible or explosive material, within thirty (30) metres from any building in the Town of Shaunavon used or intended for use, in whole or in part, as a place of dwelling, a hotel or place of public assembly. 2. (ii) nothing in subsection (i) shall be deemed to restrict the parking of any such vehicle for such period of time as may be necessary to take on or discharge cargo. 3. (iii) subject to subsection (ii) trucks and trailers carrying dangerous goods shall not park within the Town corporate limits. - (9) No person shall park a vehicle with a manufacture's rated capacity in excess of ,500 kilograms or a length in excess of 7.62 metres (25') on any streets or venues designated in APPENDIX 9 or on any streets or avenues that are in the Zoning Districts designated in APPENDIX 9. - (10) No person shall park an unregistered vehicle on any highway. - (11) No person shall park or drive a vehicle on any boulevard within the municipality. unless prior approval has been obtained from Council. - (12) No person shall park a vehicle in any "Handicapped Parking" area as designated in APPENDIX 10 at any time unless the vehicle has an official approved handicapped sign on it. - (13) No person shall park or stop a vehicle or permit a vehicle to be parked or stopped on any street or portion of any street that has been designated by temporary no parking signs; - 1) All vehicles parked on a street twelve (12) hours after the street has been signed "No Parking" shall be deemed to be illegally parked and may be impounded at the owner's expense; or 10. ii) In the event of a significant weather event or emergent situation, all vehicles parked on a street after the street has been signed "No Parking" shall be deemed to be illegally parked and may impounded at the owner's expense: and authorized personnel will provide as much public notice as possible, by means deemed appropriate. ## (h) BACKING - (1) No personal shall back a motor vehicle: 2. (i) around a corner of street intersection; or 3. (ii) along a street except when reasonably necessary in entering or leaving a parking space or due to street conditions. 4. (iii) No person shall back a motor vehicle into the opposite flow of traffic in entering or leaving a parking space. ## (i) NO TURNING - (1) No driver of a vehicle shall make a turn within an intersection or elsewhere on any street or lane at such places designated by the display of signs as shown on Schedule 30 attached hereto and forming part of this bylaw. ## POWER TURNS AND SPINNING OF WHEELS - (1) The operator of a vehicle shall not execute "Power Turns" on any highway in the municipality. 2. No person shall operate a vehicle in such a manner as to cause debris, gravel. stones or other foreign objects to be thrown by spinning of wheels. ## (k) SNOWMOBILES - (1) Notwithstanding the provisions contained in The Snowmobile Act, (and subject to section 3. (k) (2)), it shall be lawful to operate a snowmobile between the hours of 7:00 a.m. and 11:00 p.m. on any highway, except Provincial Highways No. 13 <!-- image --> - and 37 within the limits of the municipality, for the purpose of a direct route to and from the boundaries of the Town. - (2) Notwithstanding subsection (1) hereof, it shall be lawful to operate a snowmobile on the portion of Provincial Highways No. 13 and No. 37 for the purpose of crossing the provincial highways. - (3) Notwithstanding subsection (1) hereof it shall be lawful to operate a snowmobile on Centre Street from First Avenue to Fifth Avenue and on Third Avenue from Second Street West to Second Street East only at intersections thereof and only for the purpose of crossing the said street or avenue. ## (1) SPEED - Subject to subsections (2), (3), (4), and (5) no person shall operate a vehicle in the municipality at a speed greater than forty (40) km/hour. - (2) No person shall operate a vehicle at a speed greater than twenty-five (25) km/hour adjacent to nor within school zones, playgrounds, campgrounds, recreational complexes, and parks; 24 hours/day/7 days/week, including, but not limited to: - (ii) Fifth Avenue from Fourth Street West to Fifth Street East inclusive - Fourth Avenue from First Street East to Second Street East - (III) Sixth Avenue from West boundary of parcel L to East Boundary of parcel L - Seventh Avenue from Fourth Street West to Second Street West - Sixth Avenue from First Street West to Third Street West - (Vi) First Street West from Fifth Avenue to Sixth Avenue - (vili) First Street East from Fourth Avenue to Fifth Avenue - (Vil) Third Street West from Fifth Avenue to Sixth Avenue - (ix) Second Street East from Fourth Avenue to Fifth Avenue - (x) Fourth Street East from Fourth Avenue to Fifth Avenue - (xi) Fifth Street East from Sixth Avenue to Fifth Avenue - (хіїї) Within Parcel V, Plan No. 101897714; Recreation Complex - (XII) Avondale Park: Ninth Street West, south of Sixth Avenue: and the lane adjacent to Avondale Park, from Ninth Street West to Fifth Avenue. - (3) No person shall operate a vehicle at a speed greater than: - Sixty (60) km/hour on Provincial Highways No. 13 and No. 37 through the Town of Shaunavon from a point 100 metres south of its intersection with the railway tracks to a point 100 metres north of its intersection with Fifth Avenue. - (ii) Seventy (70) km/hour on Provincial Highways No. 13 No. 37 through the Town of Shaunavon from a point 100 metres north of its intersection with Fifth Avenue to the most northerly boundary of the municipality. - (4) No person shall operate a vehicle at a speed greater than Eighty (80) km/hour on the East/West route of Provincial Highway No. 13 which is within the boundaries of the municipality. - The provisions of subsections (1) to (4) shall not apply to the operators of fire engines or fire department apparatus or to vehicles being operated by law enforcement officers or to operators of ambulances or rescue vehicles where these vehicles are being operated in emergency duty and employing the siren and ## (m) U-TURNS - (1) No person shall cause a vehicle to make a U-turn between intersections, and at the intersection of a highway with a lane or an alley in the municipality. ## (n) WEIGHT RESTRICTIONS - TRUCK ROUTES - No person shall operate a vehicle or a combination of vehicles when th ombined gross weight of the vehiclers) with or without a load exceeds 12.00 kg except on a highway within the municipality designated as a Heavy Vehicle Route. as listed in APPENDIX 11 - (2) No person shall operate a vehicle or a combination of vehicles when the combined gross weight of the vehicles(s) with or without a load exceeds 62,500 <!-- image --> kg on any highway, except Provincial Highways No. 13 and 37, within the municipality. For vehicles traveling on Provincial Highways No. 13 and 37 within the municipality, the weight of a load cannot exceed the maximum allowable weight pursuant to The Vehicle Weight and Dimension Regulations, 2010. - (3) Subsections (1) and (2) shall not apply to vehicles making delivery on any highway in the municipality or obtaining repairs for the unit provided that the operator of the vehicle(s) uses the most direct route from and to the heavy vehicle route, as listed in APPENDIX 11. - (4) The provisions of The Police Act, 1990 and The Highways and Transportation Act, 1997 shall apply to the operators of vehicles referred to in subsections (1) and (2). - (5) Council may by resolution in each year restrict the travel of heavy vehicles on certain streets and/or avenues within the municipality where it is deemed these vehicles may damage said streets and/or avenues. - (6) No person operating a vehicle shall use engine retarder brakes in the Town. except to avoid or reduce the impact of a collision or in the case of such other emergency. ## (0) VEHICLES ON PUBLIC LANDS - (1) No person shall operate or park a vehicle on any areas designated in APPENDIX 12, except with the express consent of the owner or lessee of the property. - (2) The provisions of subsection (1) shall not apply to maintenance vehicles. emergency vehicles or vehicles using a designated parking area. 3. (p) BICYCLES, SKATEBOARDS, ROLLERBLADES AND/OR ROLLER SKATES (1) No person shall operate a bicycle without having at least one hand on the handlebar. - (2) No person shall operate a bicycle or a skateboard, or use rollerblades and/or roller skates on a sidewalk in the downtown core designated as C1 in The Town of Shaunavon Zoning Bylaw. - (3) No person shall operate a bicycle or skateboard, or use rollerblades and/or roller skates in a dangerous or careless manner. ## (a) LOADING ZONES - (1) No operator of a vehicle shall remain in a loading zone for a period exceeding five (5) minutes for the purpose of embarking or disembarking passengers, avided than the expiraood shal fest with the drive of any soften ir such loading zone 2. No operator of a vehicle shall remain in a loading zone for a period in excess of fifteen (15) minutes for the purpose of loading or unloading goods. 3. (г) STOP BEFORE ENTERING HIGHWAY Every driver of a vehicle within the municipality shall yield the right of way to oncoming traffic when entering a highway from a lane or other place. 4. (s) LEFT TURN BETWEEN INTERSECTIONS Mering real cause e or aley make left orderer ele ree po when forward motion. 5. (t) OBSTRUCTING TRAFFIC No driver of a vehicle within the municipality shall stop in such a fashion as to obstruct traffic. ## (u) SALE OF GOODS No person shall offer goods or services for sale on any highway, boulevard or sidewalk except when an existing business having a permanent location does so as a special romotion on the sidewalk immediately fronting their business, and then only so as t ot adversely obstruct pedestrians <!-- image --> (v) SIGHT TRIANGLE No person shall, on a street intersection site, within the sight triangle area bounded by the street lines for a distance of eight (8) metres from their common point of intersection and the diagonal which joins the extreme points; erect a structure, place an obstruction or grow vegetation over 0.6 metres above the grade of the streets that abut the site. ## (w) STOPPING PROHIBITED IN SPECIFIED PLACES - (1) except where necessary to avoid collision or conflict with other traffic or in compliance with the directions of a Police Officer: 2. (i) within an intersection 3. (il) on a sidewalk 4. (ill) on a crosswalk 5. (iv) at any other place where traffic signs prohibit stopping 6. No operator of any vehicle other than school division operated transportation vehicle and the Shaunavon Para-transit shall stop within the frontage distance of any school building as defined in APPENDIX 8 ## (x) GENERAL - (1) No person shall clean any vehicle on any highway. - (2) Vehicle repairs, including changes of tire, shall not be made on any street unless in the case of emergency repairs. ## 4. SIGNAGE - (a) Council shall cause to be erected and maintained at all stop streets listed in APPENDIX 1, at a distance of approximately three (3) metres from point of intersection, an appropriate "Stop" sign, so placed to face traffic approaching the intersection. - (b) Council shall cause to be erected and maintained at all yield intersections listed in APPENDIX 2, at a distance of approximately three (3) metres from point of intersection, an appropriate "yield" sign, so placed to face traffic approaching the intersection. - (c) Council shall cause to be erected and maintained at all intersections designated as "No U-Turn" intersections listed in APPENDIX 3, appropriate signs prohibiting U-Turns, so placed to face the traffic approaching the intersection. - (d) Council shall cause to be erected and maintained appropriate signs and/or curb markings at all "No Parking" areas listed in APPENDIX 8 and "Handicapped Parking" areas listed in APPENDIX 10. Such signs and curb markings shall be visible from that part of the highway to which the restriction applies. - (e) - (f) Council shall cause to be erected and maintained at all "Speed Bump" locations an appropriate sign warning of the bump(s) placed to face the traffic approaching the speed bump. ## 5. PARADES ANDFUNERAL PROCESSIONS - (a) PARADES A person desiring to hold a parade shall apply in writing to Council for permission. Upon making the request the person must specify the nature of the parade, the day and hour on which it is to be held, the place of formal dispersal, the exact route to be followed. Council may, at their discretion, deny the permit for the parade. ## (b) FUNERAL PROCESSIONS - 1) The lead vehicle in a funeral procession shall be identified by a distinguishing marker(s) or pennant(s). <!-- image --> - 2) Notwithstanding anything contained elsewhere in this Bylaw, the following shall apply to the use of the curb and space adjacent to any funeral parlor or other place where a funeral is to be held. 2. (i) Such use shall be applicable for one hour prior to and during actual funeral 3. (ii) The person in charge of any funeral may place markers along the curbs on either or both sides of the street adjacent to the parlor or other place where a funeral is to be held. Such markers shall indicate that the area is "Reserved for Funeral Procession" and during the time the markers are lawtully in place no person shall park a vehicle between the curb points so marked unless it is to be part of such funeral procession provided that nothing herein shall make it an offence for any person to fail to remove there from a vehicle previously lawfully parked. 4. (iii) The markers shall be removed forthwith after the funeral has been completed. - 3) Vehicles in a funeral procession shall be exempt from the requirement to stop at any designated 'four way stop', all other rules of the road must be obeyed. ## 6. PENALTIES (a) SIGNS: Any person who contravenes any of the provisions of subsection 3. (c) of this bylaw is guilty of an offence or liable on summary conviction to the penalties provided in the General Penalty Bylaw of the municipality. - (b) LUG VEHICLES AND POWER TURNS: Any person who contravenes any of the provisions of subsections 3. (f) (1) and 3. (h) of this bylaw shall be liable on summary conviction to a penalty of $200.00. ## (c) - PARKING, U-TURNS, PUBLIC RESERVE, LOADING ZONES: A person who contravenes or fails to comply with the following subsections of this bylaw or with any notice or order given hereunder shall be guilty of an offence and upon conviction, shall be liable to penalties as follows: | (1) | Any violations under Subsection 3. (h) | $ 200.00 | ## (d) NOTICE OF VIOLATION: - A violator of any of the subsections of this bylaw, as set out in Section 6.(c) upon being served with a Notice of Violation, may, during the regular office hours, voluntarily pay the penalty at the municipal office, and upon payment as so provided, that person shall not be liable to prosecution of the offence. If the prescribed penalty is not paid voluntarily within the prescribed time, charges nav be laid and if the person(s) is found guilty of an offense, is liable on summary conviction to the penalties provided in the General Penalty Bylaw of - (2) The Notice of Violation shall be in Form "2", APPENDIX 13. attached to and forming part of this bylaw. ## (e) WEIGHT RESTRICTIONS: - (1) A person who contravenes the provisions of subsections 3. (n), (1) and (2), is guilty of an offence and liable on summary conviction to a penalty of not less than $50.00, nor more than $200.00 for the first offence and not less than $100.00, nor more than $400.00 for each subsequent offence. - (2) A further penalty shall be imposed as follows 3. (i) six dollars for each 50 kg or fraction thereof for the first 1.000 kg in excess of the prescribed maximum gross weight allowable; and 4. (ii) ten dollars for each 50 kg or fraction thereof in excess of 1,000 kg that the actual gross weight exceeds the prescribed gross weight allowable, provided that in computing the further penalty, 500 kg or two percent of the maximum <!-- image --> - gross weight fixed by this bylaw, whichever is the lesser, shall not be taken into account. - (3) In each instance, the total fine shall not exceed the maximum provided for in the general penalty bylaw of the municipality. ## (f) BICYCLES, SKATEBOARDS, ROLLERBLADES AND/OR ROLLERSKATES: - (1) for the first infraction impounding the bicycle, skateboard or rollerblades/ roller skates for seven (7) days; The penalty for the contravention of subsection 3. (p) is as follows: - (2) for the second or additional infractions impounding the bicycle, skateboard or rollerblades/roller skates for fourteen (14) days. 2. (g) SPEED, FAILING TO STOP, FAILING TO YIELD, ETC. Safety Act, The Snowmobile Act and The School Bus Operating Regulations shall be liable to the penalties imposed by The Summary Offences Procedure Act, 1990 and/or The penalties for these and other traffic violations other than parking under The Traffic any other applicable legislation. ## 7. IMPOUNDING - (a) Any member of the police force or other person appointed by Council may remove or cause to be removed any vehicle that is unlawfully placed, left or kept on any street or lane, public parking place, or other public place, or municipally owned property, and to impound and store such vehicle. - (0) Where a vehicle has been impounded or stored after it has been removed under subsection (a), it may be retained at a place designated by Council for a period of thirty (30) days from the date of removal unless the costs of removal, impounding and storage are sooner paid. Upon payment of the full costs herein, the vehicle may be released to the owner thereof. - (c) If the costs of removal, impounding and storage are not paid within the period of thirty (30) days as specified in subsection (b), the Town of Shaunavon shall have the right to recover same from the owner of the vehicle by: - (1) legal action in a court of competent jurisdiction; - (2) sale by public auction on publication of a notice designating the time and place of sale at least tourteen (14) days prior to the date of the sale in a newspaper circulating in the Town of Shaunavon, and on sending such notice by registered mail to the owner at the address appearing on the last registration of the vehicle. ## 8. REPEAL OF EXISTING BYLAWS - (a) Bylaw Number 2021-017 is hereby repealed. ## 9. COMING INTO FORCE - (a) This Bylaw shall come into force upon passing of the third and final reading.
