<!-- image --> ## BYLAW NO. 478/26 TRAFFIC BYLAW <!-- image --> ## A BYLAW OF THE TOWN OF STRASBOURG, IN THE PROVINCE OF SASKATCHEWAN, TO REGULATE THE OPERATION AND PARKING OF VEHICLES AND THE USE OF STREETS The Council of the Town of Strasbourg, in the Province of Saskatchewan, enacts as follows: ## 1. SHORT TITLE - 1.1 This Bylaw may be cited as "The Traffic Bylaw." ## 2. PURPOSE - 2.1 The purpose of this Bylaw is to regulate the operation and parking of vehicles within the Town. ## 3. DEFINITIONS - 3.1 In this Bylaw: - b. Angle Parking - The parking of vehicles with the right front wheel drawn up on the righthand side of the street, or at a distance of not more than one (1) foot (30 centimetres) from such curb, with the vehicles to be placed at an angle of forty-five (45) degrees with the curb. - a. Abandoned Vehicle - A vehicle that has been left or placed on a street, public place, or land or building owned or controlled by the Town for 10 days or more, and after reasonable inquiry, the owner of the vehicle cannot be ascertained. - c. All-Terrain Vehicle (ATV) - As per the definition in The All-Terrain Vehicles Act, a selfpropelled vehicle that: - i. Is designed primarily for the movement of people or goods on unprepared surfaces; and - ii. Has wheels in contact with the ground. ## and includes: - i. A restricted use motorcycle; - ii. A mini-bike; and - ili. An all-terrain cycle. ## but does not include: - i. A golf cart; - ii. A snowmobile as defined in The Snowmobile Act; - iv. Any vehicle that is required to be registered pursuant to The Traffic Safety Act. - iii. An agricultural implement or special mobile machine as defined in The Traffic Safety Act; or - d. Boulevard - That portion of property located between the sidewalk or property pins and the adjacent street, whether marked with a curb or not. - e. Chief Administrative Officer - The person appointed as Administrator pursuant to Section 110 of The Municipalities Act. - f. Council - The Mayor and Councillors of the Town elected pursuant to the provisions of The Local Government Election Act. 2015. - g. Curb - The dividing line of the street between that part of the street intended for use of vehicles and that part of the street not so intended, whether marked with a curb or not. <!-- image --> <!-- image --> - h. Designated Officer - The Royal Canadian Mounted Police (RCMP), Bylaw Enforcement Officer, Chief Administrative Officer, or any other person appointed by the Town to enforce municipal bylaws. 2. Double Parking - The standing of a vehicle whether occupied or not: - i. Parallel to a vehicle beside the curb in a designated parking area; or - ii. Parking to the rear of any vehicle that is angle-parked at the curb in a designated angle-parking area for any reason other than delay due to traffic signs or signals. - j. Emergency Vehicles - Vehicles operated under conditions and circumstances of danger to life and property. An emergency vehicle is any vehicle that is used for any one of the following purposes: - i. Police duty; - ii. Firefighting, including a fire pumper operated under authority of Town; and - ill. Ambulance. - k. Fire Department - Strasbourg &amp; District Fire &amp; Rescue and all associated members. 1. Fire Lane - The area designated by signs or marking as a fire lane. - m. Golf Cart - A self-propelled vehicle with three or more wheels that: - i. Is designed to carry golfers and their equipment through the golf course; - ii. Cannot exceed 24 km/h; - ili. Weighs less than 1,300 lbs (590 kg) (not including the weight of the passengers and golf clubs); and - n. Impound - The seizure, removal, and detention of a vehicle. - iv. Is not defined as an all-terrain vehicle in The All-Terrain Vehicles Act or a lowspeed vehicle as defined in The Motor Vehicle Safety Regulations. - o. Intersection - The area where two or more streets meet or cross each other but does not include a lane (alley) intersection. - p. Lane (Alley) - A public street intended primarily to give access to the rear of real property. - r. Lug Vehicle - Any truck, portable engine, or traction engine having metal spikes, lugs, or cleats projecting from the face of the wheels or tires thereof or having a metal track tread - q. Level 1, Level 2 and Level 3 Gross Weights - Vehicle weights as per Appendix 11. - s. Motor Vehicle Safety Regulations - As part of The Motor Vehicle Safety Act, federal vehicle regulations for the manufacture and importation of motor vehicles and motor vehicle equipment to reduce the risk of death, injury, and damage to property and the environment. - t. Operator - A person who drives, operates, or is in charge of a vehicle on a public street. - u. Owner - The registered owner of a vehicle and includes: - i. A lessee of a motor vehicle; or - ii. A person who is in possession of a motor vehicle under a contract by which that person may become the owner of the motor vehicle on full compliance with the terms of the contract. - v. Parade - Any procession or body of pedestrians numbering more than 20, standing, marching, or walking on any street or sidewalk, or any group of vehicles numbering 10 or more (except funeral processions) standing or moving on any street. - w. Parallel Parking - The parking of a vehicle with both right wheels thereof drawn up to the curb on the right-hand side of a street, or a distance of not more than one (1) foot <!-- image --> (30 centimetres) from such curb. <!-- image --> - i. For the purpose of and while actually engaged in loading or unloading; or - X. Parking - As per The Traffic Safety Act, the standing of a vehicle, whether occupied or not, on a street, other than standing temporarily: - il. In obedience to traffic regulations, traffic control devices, or the directions of a Designated Officer. - y. Parking Area - A portion of a street or an area indicated by signs or markings or parking meters as a place to park. - z. Pedestrian - A person traveling on foot or confined to a wheelchair, whether powered by human power or by motor. 6. aa. Public Place - Any place, building, or conveyance to which the public has access by right or by invitation, expressed or implied, and for greater certainty but not to restrict the meaning thereof, shall include community halls, hockey and curling rinks, churches, restaurants, hotels, motels, stores, and public parks. 7. bb. Recreational Vehicle - A self-propelled or towed vehicular type unit, primarily designed as temporary living quarters for recreational, camping, or travel use, and which is used solely as a family or personal conveyance and in no way used for commercial purpose. Without limiting the foregoing, recreational vehicles include: - i. Travel trailer; - ii. Cabin trailer; - iii. Tent trailer; - iv. Truck camper; - v. Motor home; - vi. Park trailer; - vii. Fifth-wheel travel trailer. - dd. Sidewalk - That portion of a street used exclusively for pedestrians, including walking trails. - cc. Saskatchewan Government Insurance (SGI) - Crown corporation owned by the Government of Saskatchewan responsible for the public auto insurance program Saskatchewan Auto Fund, as well as driver licensing and motor vehicle registration. 17. ee. Sidewalk Crossing - That portion of a sidewalk permanently improved or designated for the passage of vehicular traffic. - i. Is not equipped with wheels but is equipped with tractor treads alone or with skis or with skis and a propeller; or 19. ff. Snowmobile - A vehicle that: - ii. A toboggan equipped with tractor treads or a propeller; and - iii. Is designed primarily for operating over snow and is used exclusively for that purpose; and - iv. Is designed to be self-propelled; and - v. Does not weigh more than 1,100 pounds (500 kilograms). 24. gg. Speed Zone - Any portion of a street within the Town, as designated herein, and identified by a sign erected and maintained at each end thereof, indicating the maximum speed applicable thereto. 25. hh. Street - Any road, street, road allowance, or land vested in the Crown in the right of Saskatchewan, or set aside for the purpose of the Crown in the right of Saskatchewan pursuant to any Act, but does not include a provincial highway within the Town as designated pursuant to the provisions of The Highways and Transportation Act, 1997. - ii. Town - The Town of Strasbourg. <!-- image --> - jj. Traffic - Pedestrians, ridden animals, vehicles, buses, and other conveyances e single or together while using any streets. - kk. Traffic Sign - Any sign, signal (other than traffic signals), marking or other device placed, painted, or erected for the guidance, regulation, warning, direction, or prohibition of traffic. - Il. U-Turn - The turning of a vehicle so as to cause it to proceed in the opposite direction from which it was proceeding immediately prior to the commencement of such turn. - mm. Vehicle - As per The Traffic Safety Act, a device in, on, or by which a person or thing is or may be transported or drawn on a street and includes special mobile machines and farm implements but does not include vehicles running only on rails or solely on railway company property. - nn. Vehicle Equipment Regulations - As part of The Traffic Safety Act, provincial vehicle regulations that outline the types of vehicles on Saskatchewan roads. <!-- image --> ## 4. TRAFFIC SIGNS - 4.1 All stop signs shall be erected and maintained at a distance of approximately 10 feet (three (3) metres) from a street intersection at a 90-degree angle to the traffic approaching the intersection. - 4.2 ALL "Stop" streets in the Town are listed in Appendix 1, which is attached hereto and forms part of this Bylaw. - 4.3 The Town shall maintain and/or erect any signage to indicate "3-Way Stop" or "4-Way Stop" intersections. Such signs shall be visible for that part of the street to which the restriction applies. - 4.4 All "3-Way Stop" and "4-Way Stop" intersections in the Town are listed in Appendix 2, which is attached hereto and forms part of this Bylaw. - 4.5 All yield signs shall be erected and maintained at a distance of approximately 10 feet (three (3) metres) from a street intersection at a 90-degree angle to the traffic approaching the intersection. - 4.6 All "Yield" streets in the Town are listed in Appendix 3, which is attached hereto and forms part of this Bylaw. - 4.7 The Town shall maintain and/or erect any signage to indicate "No U-Turn" intersections. Such signs shall be visible for that part of the street to which the restriction applies. - 4.8 "No U-Turn" intersections in the Town are listed in Appendix 4, which is attached hereto and forms part of this Bylaw. - 4.9 The Town shall maintain and/or erect any signage to indicate "No Parking" areas as listed in Appendix 5, which is attached hereto and forms part of this Bylaw. Such signs shall be visible for that part of the street to which the restriction applies. - 4.10 The Town may maintain and/or erect any signage as it may deem relevant for warning, guidance, directions, or information purposes. General signage as referred to in this Bylaw are exempt from conditions and/or specifications set forth in the Town's Zoning Bylaw. <!-- image --> - 4.11 No person shall, except where authorized by resolution of Council, or when duly authorized by law, erect upon or immediately adjacent to any street, any sign, marker, signal, light, or any advertising sign or device. - 4.12 No person shall deface, damage, destroy, or remove any sign or marker erected pursuant to this Bylaw. <!-- image --> ## 5. PARKING - 5.1 Except as otherwise provided herein, the parking of vehicles is permitted on all streets within the Town. - Subject to the provisions of Subsection 5.3, no person shall park a vehicle within 10 feet (three (3) metres) of the entrance to any street, lane, or driveway, or park on any street so as to obstruct the entrance to any lane or to a driveway or approach leading to private premises. - 5.3 Notwithstanding the provisions of Subsection 5.2, a vehicle may be parked in any lane for the purpose of taking on or discharging cargo, provided no such vehicle shall be parked for a period exceeding 30 minutes at one time, unless written permission has first been obtained from the Chief Administrative Officer for an extension of such time. - 5.4 Subject to Subsection 5.5 every person parking a vehicle upon a street within the Town where parking is permitted, shall parallel park the same on the right side of the street within one (1) foot (30 centimetres) of the curb, in the proper direction. - 5.5 Every person parking a vehicle upon a street shall angle park as indicated in Appendix 6, which is attached hereto and forms part of this Bylaw. - 5.6 No person shall park a vehicle within 16 feet (five (5) metres) of any fire hydrant. - 5.7 No person shall park a vehicle within 20 feet (six (6) metres) of any street intersection. - 5.8 No person shall park a vehicle next to a curb that has been painted yellow. - 5.9 No person shall park a vehicle so that any portion of the vehicle extends over a sidewalk or sidewalk crossing. - 5.10 No person shall park a vehicle anywhere with a fire lane, or other property specifically reserved for Emergency Vehicles. - 5.11 No person shall park a vehicle on any street at one place for any period of time exceeding 72 consecutive hours. - 5.12 No person shall leave a travel trailer, utility trailer, semi-trailer, boat, or any other type of trailer that can be hitched to a vehicle, parked on a street which is unattached from a vehicle used for moving same, subject to Subsection 5.11. - 5.13 No person shall park any vehicle in any private place or on any private property unless they <!-- image --> are the owner, occupant, licensee, or permittee of the parking place or private prop except with the consent of such owner, occupant, licensee, or permittee. <!-- image --> - 5.14 Subject to Subsection 5.15, no person shall park any vehicle designated for carrying or intended for the carrying of oil, gasoline, or other flammable, combustible or explosive material, within 100 feet (30 metres) from any building in the Town used or intended for use, in whole or in part, at a place of dwelling, a hotel, or place of public assembly. - 5.15 Nothing in Subsection 5.14 shall be deemed to restrict the parking of any such vehicle for such period of time as may be necessary to take on or discharge cargo. - 5.16 No person shall park a vehicle in designated Disabled Parking zones unless the vehicle displays a handicap placard in the vehicle's front windshield. This does not apply to Emergency Vehicles. - 5.17 No vehicle shall be parked on a public street unless it is displaying valid license plates. - 5.18 Parking on public parking lots shall be limited to use only by patrons of the attached public facility or at the discretion of the Town. - 5.19 No person may operate or park a vehicle on any areas designated in Appendix 7 as Public Places. - 5.20 Subsection 5.19 does not apply to maintenance vehicles or vehicles using a designated parking area or vehicles being operated by a Designated Officer. - 5.21 No person shall double park a vehicle upon any street in the Town. - 5.22 No person shall leave a vehicle unattended on a jack or jacks with one or more wheels removed for more than three (3) hours on any street or on unoccupied Town property without the vehicle being sufficiently blocked to stop the vehicle from falling onto the ground. - 5.23 No person shall stand or park a vehicle or recreational vehicle on any street or public property for the purpose of vehicle repairs, with the exception of emergency repairs limited to three (3) hours. - 5.24 Contractor vehicles used by contractors while carrying out work inside buildings or other places of work shall be exempt from the daily restricted parking provisions of this Bylaw, providing that any such contractor vehicle is parked adjacent to the building or place where the contractor is actively carrying out the work, and providing that it is carrying equipment or material necessary to the work which cannot be conveniently unloaded and kept otherwise than on or in the contractor vehicle in question. ## 6. PARKING OF RECREATIONAL VEHICLES - 6.1 An owner or operator of a recreational vehicle shall not park the recreational vehicle on a street in Town for more than 72 consecutive hours following which the owner or operator shall move the recreational vehicle to an off-street location for a period of not less than 72 consecutive hours before the recreational vehicle may be parked again on a street. <!-- image --> - 6.2 No owner or operator of a recreational vehicle shall park the recreational vehicle on any street in such a manner as to constitute a hazard to other persons using the street. - 6.3 Owners or operators of recreational vehicles shall be permitted to park a recreational vehicle on their boulevard throughout the year provided that: - a. The slide-out extensions do not extend past the curb or over the sidewalk when - b. Sightlines at intersections are not obstructed; - c. Sightlines for neighbouring private driveways are not obstructed; - d. Snow removal and other Town boulevard maintenance is not hindered, including tree pruning/removal, curb stop maintenance/replacement, etc. - e. The recreational vehicle can easily be removed at the Town's request. - 6.4 Owners or operators of recreational vehicles that are parked on the Town's streets or boulevards are doing so at their own risk and assume any liability that may arise. - 6.5 Any recreational vehicle parked on a street or boulevard shall display a valid license plate. <!-- image --> ## 7. STREET MAINTENANCE AND SNOW ROUTE AREAS - 7.1 Street maintenance may include, but not limited to, street cleaning, snow removal, line painting, roadway repair, and other similar activities. - 7.2 No person shall park or stop on any street identified for maintenance or snow removal. This can be identified by snow route or maintenance signage (sandwich boards) or through other designated signage or maps. - 7.3 Any vehicles parked on designated streets where snow removal or maintenance is scheduled may be moved, without notice, for such distance as is necessary, or impounded by the Town at the expense of the registered owner of the vehicle. ## 8. SPEED - 8.1 No person shall operate a vehicle in the Town at a speed greater than 40 km/h except on Highway No. 20 through the Town, where no person shall operate a vehicle at a speed greater than 60 km/h. - 8.2 No person shall operate a vehicle at a speed greater than 40 km/h on Grid Road 731 between the railway tracks and Range Road 2220. - 8.3 No person shall operate a vehicle at a speed greater than 80 km/h on both Grid Road 731 west of Highway No. 20 and on Range Road 2221. - 8.4 No person shall operate a vehicle in Town at a speed greater than 30 km/h on Mountain Street from Currie Crescent to Highway No. 20, which is a designated school zone. - 8.5 No person shall operate a vehicle at a speed greater than 30 km/h on Edwards Street between Highway No. 20 and Prospect Avenue, which is adjacent to the Lions Park. <!-- image --> ## 9. U-TURNS <!-- image --> - 9.1 No person shall cause a vehicle to make a U-Turn between intersections, and at the intersection of a street with a lane or an alley in the Town other than on Mountain Street. - 9.2 No person shall cause a vehicle to make a U-Turn at the intersection designated as a "No U-Turn" intersection as listed in Appendix 4, which is attached hereto and forms part of this Bylaw. This shall apply to all traffic approaching and facing a "No U-Turn" sign erected and maintained in accordance with the provisions of Subsection 4.8. - 9.3 No person shall cause a vehicle to cross over the solid yellow line or make a turn on Mountain Street except at an intersection. ## 10. WEIGHT RESTRICTIONS, TRUCK ROUTES, &amp; SCHOOL BUSES - 10.1 Notwithstanding Subsection 10.2, no person shall operate a Level 1, Level 2, or Level 3 vehicle weighing with or without its load more than 17,637 lbs (8,000 kg) on or over the public streets listed in Appendix 8, which is attached hereto and forms part of this Bylaw. - 10.2 Subject to Subsection 10.1, no person shall operate any vehicle on any street within the Town designated as a "Truck Route" as listed in Appendix 9, which is attached hereto and forms part of this Bylaw, that with or without the load exceeds the following weight as per The Vehicle Weight and Dimension Regulations, 2010: - 10.3 For Erickson Road, which is classified as a secondary highway, the weight load cannot exceed 120,151 lbs (54,500 kg). - 10.4 School buses are required to operate on either the Truck Route as listed in Appendix 9 or the School Bus Route as listed in Appendix 10. School buses are not permitted to travel or park on any other residential street. - 10.5 Subsection 10.1 does not apply to: - a. Motor vehicles designed specifically to convey garbage; - b. Emergency vehicles. - 10.6 Subsection 10.1 shall not apply to vehicles making a local delivery on any street in the Town provided that the operator of the vehicle uses the most direct route from and to the truck route as listed in Appendix 9. - 10.7 Winter weight allowances for the truck route and Erickson Road will be in effect as per the annual Minister's Order from the Ministry of Highways. SNOWMOBILES - 11.1 Under the provisions of The Snowmobile Act, the operation of snowmobiles is prohibited on: - a. The untraveled portion of the whole or any part of a street, other than a provincial <!-- image --> highway, in the Town; - b. Any private land in the Town; - c. Any municipal land in the Town. 3. 11.2 Notwithstanding the provisions contained in accordance with The Traffic Safety Act, The Snowmobile Act, and subject to Subsection 11.1, it shall be lawful to operate a snowmobile between the hours of 7:00 a.m. and 10:00 p.m. on any street, except Highway No. 20 within the limits of the Town, for the purpose of a direct route to and from the boundaries of the Town providing: - a. That any snowmobiles crossing Highway No. 20 comes to a full stop prior to - b. That the snowmobiles takes that most direct route across Highway No. 20; and - c. That any snowmobiles entering onto Highway No. 20 shall do so from an established public street approach. ## 12. GOLF CARTS - 12.1 It shall be lawful to operate a Golf Cart during the daylight hours one half hour before sunrise and one half hour after sunset within the limits of the Town, for the sole purpose of transportation to and from the Strasbourg Golf Course at 13749 Grid Road 731 by the direct shortest distance between the Strasbourg Golf Course and where the golf cart is stored. - 12.2 Persons operating a Golf Cart on the streets within the limits of the Town must not be operated on any provincial highway, other than to cross one. - 12.3 Golf Carts cannot be operated on any street with a posted speed over 50 km/h. - 12.4 Golf Carts shall display a slow moving warning sign at the rear, as near to the centre as practicable with one side parallel to and not less than 900 millimetres (35 inches) or more than 1,500 millimetres (60 inches) from the ground, as per Clause 2(1)(kk) of The Vehicle Equipment Regulations. - 12.5 No person shall operate a Golf Cart on the streets within the limits of the Town without a valid driver's license. All drivers of Golf Carts must hold, at minimum, a valid Class 7 driver's license. - 12.6 The owner of the golf cart must carry a minimum of $200,000 in third party liability insurance and must also provide proof of insurance at the request of a Designated Officer. - 12.7 Golf Carts must be operated in accordance with the rules of The Traffic Safety Act and the provisions of this Bylaw. Federal and provincial impaired driving laws also apply to the operation of a Golf Cart. - 12.8 The Town will monitor and inform Saskatchewan Government Insurance (SGI) of any collisions involving Golf Carts that occur and if there are any injuries or fatalities. ## 13. ALL-TERRAIN VEHICLES - a. The untraveled portion of the whole or any part of a street, other than a provincial 2. 13.1 Under the provisions of The All-Terrain Vehicles Act, the operation of all-terrain vehicles is prohibited on: <!-- image --> <!-- image --> highway, in the Town; - b. Any private land in the Town; - c. Any municipal land in the Town. 3. 13.2 Notwithstanding, the provisions contained in accordance with The Traffic Safety Act, The All-Terrain Vehicles Act, and subject to Subsection 13.1, it shall be lawful to operate an allterrain vehicle between the hours of 7:00 a.m. and 10:00 p.m. on any street, except Highway No. 20 within the limits of the Town, for the purpose of a direct route to and from the boundaries of the Town providing: - a. That any all-terrain vehicles crossing Highway No. 20 come to a full stop prior to crossing; - c. That any all-terrain vehicles entering onto Highway No. 20 shall do so from an established public street approach. - b. That the all-terrain vehicles take that most direct route across Highway No. 20; 7. 13.3 Notwithstanding the provisions contained in The All-Terrain Vehicles Act, it shall be lawful to operate an all-terrain vehicle for the purpose of private property maintenance including snow removal. 8. 13.4 Notwithstanding the provisions contained in The All-Terrain Vehicles Act, the following conditions of operating an all-terrain vehicle shall be as follows: - b. The operator of the all-terrain vehicle must not be under the age of 16 and must possess a valid driver's license. - a. The all-terrain vehicle is equipped with all lighting and safety equipment required by The All-Terrain Vehicles Act - c. The all-terrain vehicle must be operated in a careful and prudent manner with due regard for persons, property, and traffic. - d. Travel at a maximum speed of 30 kilometres per hour unless otherwise posted. - e. Travel as near as practicable to the right-hand side of the roadway. - f. Obey all traffic control devices and traffic regulations applicable to motor vehicles. - h. The operator must wear a helmet that meets the requirements as stated in The AllTerrain Vehicles Act. - g. Yield the right-of-way to all motor vehicles and pedestrians. - i. Any person operating an all-terrain vehicle shall require third party liability insurance coverage as required by Section 14 of The All-Terrain Vehicles Act. ## 14. PARADES - 14.1 No parade shall be held without first obtaining a Road Closure Permit from the Town for the proposed parade. - 14.2 No person shall participate in a parade for which a Road Closure Permit has not been granted. - 14.3 Application for a Road Closure Permit for a parade shall be made in writing to the Town as per Form 2, which is attached hereto and forms part of this Bylaw, giving the nature of the parade, the intended route, the number of persons and vehicles expected to take part, and the estimated time required for the parade to pass a given point. <!-- image --> <!-- image --> - 14.4 All applications for a Road Closure Permit for a parade shall be made to the Town at least seven (7) days prior to the day of the parade to allow the Town ample time to arrange for policing the route and provide barricades. - 14.5 The Town is hereby empowered to close whatever streets they deem necessary during the passage of any parade and to divert traffic to other streets. - 14.6 During any parade, all pedestrians not taking part therein shall be restricted to the use of the sidewalk. - 14.7 Except with permission in writing by the Town, all parades must proceed on the right side of the street. - 14.8 No vehicle and/or pedestrian shall interfere, obstruct, or cross through any street of a parade route. <!-- image --> ## 15. TEMPORARY STREET CLOSURES - a. Enabling work to be carried out by or on behalf of the Town including road maintenance, street cleaning, snow removal, or sewer and water construction, repair, or improvements. 2. 15.1 Notwithstanding any other provision in this Bylaw, the Chief Administrative Officer, Council, and Public Works Foreman, shall have the authority to temporarily close streets to vehicular traffic or restrict traffic, parking, or stopping on any street for the purpose of: - b. Facilitating the moving of any building, structure, machine, or other object for which a permit has been issued by the Town. - c. Facilitating the construction, repair, or demolition of a building, structure, or other object for which a permit has been issued by the Town. - d. Facilitating public gatherings. 6. 15.2 Individuals and organizations must apply for a Road Closure Permit as found in Form 2, which is attached hereto and forms part of this Bylaw, prior to approval by the Chief Administrative Officer of any street or sidewalk closure. 7. 15.3 Notwithstanding any other provision of this Bylaw, a Designated Officer hired to enforce this Bylaw shall have the authority to temporarily close streets to vehicular traffic or restrict traffic, parking, or stopping on any street to avoid traffic congesting, danger, accident, traffic signal malfunction, or other emergencies. 8. 15.4 Notwithstanding any other provision of this Bylaw, the Fire Chief has the authority to temporarily close streets to vehicular and pedestrian traffic for the purposes of scheduled fire department training. 9. 15.5 Where a street has been closed pursuant to Subsection 15.1, the Town shall install such temporary stop, yield, no parking, or detour signs as may be required. 10. 15.6 For the purpose of street repair and maintenance, the Town may move, for such distance as is necessary, any vehicle that is parked on any street or portion thereof which is roped off, barricaded, or indicated by notice or sign as being closed. <!-- image --> - 15.7 No person shall drive, park, or stop a vehicle or walk on any street or portion thereof that is roped off, barricaded, or indicated by sign or notice as being closed. - 15.8 On days when school is in session, William Derby School are permitted to prevent all vehicular traffic from accessing the lane east of the School between Mountain Street and the four way stop from 8:00 a.m. to 3:30 p.m. It is the School's responsibility to place and remove traffic barriers, such as traffic cones, during this period of time. <!-- image --> ## 16. EMERGENCY TRAFFIC - 16.1 Notwithstanding any other provisions of this Bylaw, a Police Officer, a person designated by a Police Officer, the Fire Chief, or Bylaw Enforcement Officer are hereby authorized to direct or prohibit traffic on any public street in any manner they deem necessary to expedite traffic, safeguard pedestrians, prevent accidents, or meet any unforeseen conditions, whether or not in conformity with this Bylaw or The Traffic Safety Act, in the event of a fire, traffic accident, traffic signal light malfunction, or other emergency. - 16.2 Every person shall comply with any traffic signal or direction of a Police Officer, person designated by a Police Officer, the Fire Chief, or Bylaw Enforcement Officer given pursuant to this Section. ## 17. SIDEWALK, LANE, &amp; STREET OBSTRUCTIONS - 17.1 No person shall obstruct the free passage of traffic on any sidewalk, lane, or street without first informing the Town. - 17.2 Subsection 17.1 shall not be construed as prohibiting the gathering of individuals on any sidewalk, lane, or street for a lawful purpose so long as the proceedings there are peaceable and orderly, and sufficient space is left both on the sidewalks, lanes, and streets to accommodate the traffic on the sidewalks, lanes, and streets. - 17.3 If water drains from a roof or eaves upon a sidewalk, lane, or street, the owner or occupant of the premises shall clean the sidewalk, lane, or street portion thereof to prevent ice from forming thereon. - 17.4 No person shall plant trees, hedges, or shrubs exceeding three (3) feet (one (1) metre) in height, within 25 feet (7.5 metres) at any intersection. - 17.5 The Designated Officer may order than any hedge, shrub, tree, or other obstruction be removed, trimmed, or cut down, for the safety of pedestrian or vehicular traffic on a street where a visual obstruction is present. - 17.6 No person shall place any electrical cord, lumber, tree branch, or any other material across any sidewalk, lane, or street in such a manner that it obstructs or provides an unsafe situation for pedestrian or vehicular traffic. ## 18. DAMAGE TO SIDEWALKS, LANES, &amp; STREETS - 18.1 No person shall willfully excavate or trench any sidewalk, lane, or street without written approval from the Town. <!-- image --> <!-- image --> - 18.2 No person shall operate a vehicle, specifically a lug vehicle, on a sidewalk, lane, or street if the vehicle would tear, gouge, scar, or otherwise cause damage to the sidewalk, lane, or street. ## 19. ILLEGAL CROSSINGS - 19.1 No person operating a vehicle shall cross a fire hose or any fire equipment unless it is protected with planking and provisions that have been made to cross it by the Fire Department. - 19.2 No vehicle shall cross the ditches along Erickson Road and on Highway No. 20 as a means to enter onto a property. - 19.3 No person shall drive or walk on or over a newly painted line on any street where such line is indicated by accepted warning or directional markers or signs. ## 20. CONTRAVENTION OF BYLAW - 20.1 Any person who contravenes any of the provisions of this Bylaw or fails to comply therewith or with any notice given thereunder is guilty of an offence and be liable to the penalties as hereinafter provided. Said offence and penalties shall be listed in Schedule A, which is attached hereto and forms part of this Bylaw. - 20.2 The penalties for traffic violations other than parking under The Traffic Safety Act, The Snowmobile Act and The ATV Act shall be liable to the penalties imposed by The Summary Offences Procedure Act and/or any other applicable legislation. - 20.3 Except where otherwise specified in this Bylaw, any person who contravenes any provision of this Bylaw is guilty of an offense punishable on summary conviction by a fine in an amount not exceeding $2,000.00 dollars. - 20.4 Any Police Officer responsible for policing the Town, the Bylaw Enforcement Officer, or any other person specifically appointed by the Town are hereby designated to enforce all sections of this Bylaw. - 20.5 Notwithstanding any other provisions of this Bylaw, the registered owner of any vehicle shall be liable for a violation of any provision of this Bylaw, as well as the person who committed the breach, unless the registered owner proves to the satisfaction of the judge trying the case that, at the time of the breach, the vehicle had been stolen from them or taken, without their consent express or implied, out of their possession or out of the possession of a person entrusted by them with its care. ## 21. WARNING NOTICE &amp; NOTICE OF VIOLATION - 21.1 No person, other than a Designated Officer may place a Warning Notice or Notice of Violation on any vehicle. - 21.2 At the discretion of the Designated Officer, a Warning Notice may be issued prior to the issuance of a Notice of Violation. - 21.3 Service of the Warning Notice and Notice of Violation may be made by any one of the Bylaw 478/26 - Regulate the Operation of Vehicles Bylaw Page 13 of 24 <!-- image --> following methods, and if so made, shall be deemed to be effective service fo purposes of this Bylaw: <!-- image --> - a. By delivering it personally to the individual, or a person over the age of 18 at the respective residence; - b. By placing the Warning Notice or Notice of Violation on the vehicle in respect of which an offence is alleged to have been committed; - c. By sending it registered mail to the individual's last known address; or - d. In case of a parking violation, by regular mail. 5. 21.4 No person, other than the owner or operator of the vehicle, shall remove a Warning Notice or Notice of Violation from any vehicle. 6. 21.5 The Chief Administrative Officer may only cancel a Warning Notice or Notice of Violation where, in their opinion, the Warning Notice or Notice of Violation was issued improperly or in error. 7. 21.6 A violator of any of the sections of this Bylaw, upon being served with a Notice of Violation, may during the regular office hours, voluntarily pay the penalty at the municipal office within 14 days and upon payment as so provided, that person shall not be liable to prosecution of the offence. 8. 21.7 The Warning Notice and Notice of Violation shall be in Form 1, which is attached hereto and forms part of this Bylaw. ## 22. REMOVAL OF OBSTRUCTIONS, ENCUMBRANCES, OR ENCROACHMENTS - 22.1 Where an obstruction, encumbrance, or encroachment is created or left on any street, lane, boulevard, or sidewalk, any person authorized by the Town may remove or cause to be removed that obstruction, encumbrance, or encroachment at the cost of the person who caused the same and may destroy or otherwise dispose of the same. ## 23. PROSECUTION FOR DAMAGES - 23.1 Nothing in this Bylaw shall be construed to curtail or abridge the right of the Town to prosecute an action for damages by reason of damage suffered to any municipal property resulting from the contravention of any of the provisions of this Bylaw. ## 24. AUTHORITY OF THE DESIGNATED OFFICER - 24.1 The operator of any vehicle shall, upon request of a Designated Officer, take the vehicle to any scale chosen by the Designated Officer and have the vehicle weighed. ## 25. SEIZURE, REMOVAL, AND IMPOUNDING OF VEHICLES - 25.1 In addition to and notwithstanding any provisions contained within Section 25 hereof, any Designated Officer may remove or cause to be removed any vehicle that contravenes any section of the Bylaw and may include, but it not limited to: - a. Any vehicle that is unlawfully placed, left or kept on any street, other public place, or on municipal property; - b. Any vehicle that is unlawfully parked pursuant to Section 5; - c. Any vehicle found on a street, public parking place, other public place or municipal property where: - i. The owner of the vehicle owes three (3) or more outstanding fines to <!-- image --> the Town for parking offences; <!-- image --> - iii. At least two (2) notices that the fines are outstanding were sent to the owner at least one (1) week apart; or - ii. The appeal period against the imposition and amount of said fines has expired; - iv. A justice, having been satisfied by evidence provided by way of oath, affidavit, or statutory declaration of the existence of the facts mentioned above in Clauses 25.1(c)(i-iii) has issued an order authorizing the removal and impoundment. - d. And seize, impound, or store such vehicles. 5. 25.2 The Town may retain a vehicle which has been impounded or stored at any place authorized by the Town after it has been removed under Subsection 25.1 until the amount of outstanding fines, if any, and the costs incurred in removing and impounding or storing the vehicle have been paid, and upon payment of said outstanding fines and costs the vehicle shall be released to the owner. 6. 25.3 If the fines and costs described in Subsection 25.2 have not been paid within a period of 30 days, the Town shall have the right to recover same from the owner of the vehicle by: - a. Legal action in a court of competent jurisdiction; - b. Sale through public auction; or - c. Private sale of the vehicle. 10. 25.4 Prior to the sale of a vehicle which has been impounded or stored under this Section, the Town shall provide notice designating the time and place of the sale at least 14 days prior to the sale by: - a. Publishing a notice on the Town's website; - b. Sending a copy of said notice by regular mail to the owner at the address last appearing on the vehicle registration; and - c. Any other means which Council may consider appropriate. 14. 25.5 The proceeds from such sale shall be applied firstly on the fines and costs described in Subsection 25.2 and the balance remaining, if any, shall be paid to the owner. 15. 25.6 If the proceeds from such sale are insufficient to satisfy the fines and costs described in Subsection 25.2, the amount of the shortfall shall be a debt due and owing from the owner and enforceable by the Town in any manner allowed by law. ## 26. ABANDONED VEHICLES - 26.1 Abandoned vehicles shall be dealt with as provided under Section 371 of The Municipalities Act. ## 27. SEVERABILITY - 27.1 A decision of the court that one or more of the provisions of this Bylaw are invalid in whole or in part does not affect the validity, effectiveness, or enforceability of the other provisions or parts thereof with respect to this Bylaw. <!-- image --> ## 28. REPEAL OF BYLAWS <!-- image --> - 28.1 Bylaw No. 456/25 being a Bylaw to Regulate the Operations of Vehicles is hereby repealed. - 28.2 Bylaw No. 471/25 being a Bylaw to Amend the Operations of Vehicles Bylaw is hereby repealed. ## 29. COMING INTO FORCE - 29.1 This Bylaw shall come into force and take effect on the final date of passing by Council. Read a first time this 24t day of June, 2026.
