TOWN OF TISDALE
BYLAW NO. 17/11
A BYLAW TO REGULATE THE OPERATION AND PARKING OF
VEHICLES AND THE USE OF THE HIGHWAYS IN THE TOWN OF
TISDALE.
The Council of the Town of Tisdale, in the Province of Saskatchewan, enacts as follows:
1.
Short Title
This Bylaw may be cited as the Traffic Bylaw.
2.
Application
All of the provisions and enactments set forth in this Bylaw shall relate to and be in
full force and effect within the limits of the Town of Tisdale.
3.
Interpretation
a) In this Bylaw, unless the context otherwise requires, the expression(s):
1)
"Authorized Person" means a person who is in charge of a vehicle with the
express or implied consent of the owner of the vehicle;
2)
"Bicycle" shall mean a vehicle for the carriage of persons, which is
propelled by human power, having two tandem wheels, and including any
device adapted from a bicycle by the addition of one or more wheels.
3)
"Boulevard" shall mean that portion of a roadway lying between the curb
line of a roadway and adjacent property line, whether actually planted or
improved or not, excepting that portion occupied by a sidewalk. Where
there is no curb it shall mean that portion of a roadway ordinarily traveled
by vehicles and the adjacent property line, excepting that portion occupied
by a sidewalk.
4) "Bus Stop" shall mean that portion of a public highway adjacent to the curb
designated by signs and/or markings as such, for the purpose of loading and
unloading passengers from buses operated by the Saskatchewan
Transportation Company or any other transit authority.
5)
"Chief of Police" shall mean the NCO or Officer in Charge of the Tisdale
Detachment of the Royal Canadian Mounted Police.
6)
"Council" shall mean the Council of the Town of Tisdale.
7)
"Curb" shall mean the lateral boundaries of a highway whether or not
marked by curbing.
8)
"Dispatched Intersection" shall mean an intersection at which the
movement of traffic is controlled by a traffic officer, a traffic light, signal or
other traffic sign or device.
9)
"Double Parking" shall mean the standing of a vehicle, whether occupied or
not, parallel to a vehicle parked beside a curb for any reason other than
delay due to traffic sign or signals.

10) "Driver" shall mean any person who drives, operates or is in charge of a
vehicle on a highway and includes an operator.
11) "Emergency Vehicle" shall mean an emergency vehicle as defined in the
Highway Traffic Act of Saskatchewan.
12) "Heavy Vehicle" shall mean a motor vehicle with or without load which
along or together with any trailer, semi-trailer or other vehicle being towed
weighs 3,000 kilograms or more.
13) "Highway Intersection" shall mean an area where two or more highways
meet or cross each other but does not include a "lane intersection".
14) "Holiday" shall mean any statutory holiday or any civic holiday declared by
the Town Council.
15) "Impound" shall mean and include the seizure, removal and detention of a
vehicle.
16) "Lane" shall mean that kind or type of a public highway intended primarily
to give access to the rear of real property and intended primarily for the use
of vehicles.
17) "Lane Crossing" shall mean and be included in the prolongation of the
lateral boundary lines across the adjacent sidewalks.
18) "Lane Intersection" shall mean an area where a lane meets or crosses a
highway.
19) "Livestock", "Motorcycle", "Operator", "Parking", "Highway", "Semi
Trailer", "Stop", "Traffic Lane", "Truck", and "Vehicle", shall have the
meaning given to them in the Highway Traffic Act and amendments
thereto.
20) "Loading Zone" shall mean the portion of a highway adjacent to the curb
designated by signs and/or markings for the exclusive use of vehicles
loading or unloading passengers or goods.
21) "Lug Vehicle" shall mean any vehicle portable engine or traction engine
having metal spikes, lugs or cleats projecting from the face of the wheels or
tires thereof, or having metal track tread;
22) "Owner" means, with respect to any vehicle, the person to whom a current
certificate of registration or registration permit for a vehicle is issued;
23) "Parade" shall mean any group of pedestrians marching or walking along a
highway and numbering fifty (50) or more or any group of vehicles
numbering ten (10) or more and proceeding on a highway under a common
leadership except funeral processions.
24) "Parallel Parking" shall mean parking a vehicle on a highway parallel to the
curb with the wheels of the right side of the vehicle within 30 centimeters
of the curb.
25) "Parking Lot" shall mean any area, whether publicly or privately owned,
that is primarily intended to be used for the parking of vehicles and the
necessary passage ways in that area.
26) "Parking Stall" shall mean a portion of a highway or an area indicated by
signs and/or markings as a parking space for one vehicle only.

27) "Pedestrian" shall include a person in a baby carriage, stroller, wheelchair
or motorized personal carrier.
28) "Pedestrian Crosswalk" shall mean that portion of a highway designated by
signs and/or markings for the use of pedestrians to cross a highway or
where there are no signs or markings, shall mean that portion of a highway
within the prolongation of the lateral boundary lines of sidewalk at the end
of a block.
29) "Person" shall mean all human beings of either sex and shall include
corporations, associations or other aggregations of individuals.
30) "Police Officer" shall mean any member of the Royal Canadian Mounted
Police and Highway Traffic Officer for Saskatchewan.
31) "Power Turn" shall mean the maneuvering of a vehicle in such a manner as
to cause the rear of the vehicle to depart from the ordinary line of progress
by the sudden use of acceleration and/or braking.
32) "Private Roadway" shall mean a roadway or a driveway located on privately
owned property.
33) "Property Line" shall mean the line marking the boundary between any
roadway and the lots abutting thereon.
34) "Public Place" shall mean any place, building or conveyance to which the
public has access by right or by invitation, expressed or implied and for
greater certainty but not to restrict the meaning thereof, shall include dance
halls, theaters, skating and hockey rinks, curling rinks, churches, church
halls, meeting halls, restaurants, beer parlors, bowling alleys, poolrooms,
hotels, motels, motor hotels, stores, malls and parks.
35) "Public Works Director" shall mean the Town Foreman for the Town of
Tisdale and anyone acting or authorized by the Public Works Director to act
on his behalf.
36) "Right-of-Way" shall mean the priority of immediate use of highways,
highway intersection, highway crossing or lane crossing.
37) "School Crosswalk" shall mean an area designated under Section 7 of this
Bylaw.
38) "Snowmobile" shall mean a snowmobile as defined in The Snowmobile
Act.
39) "Town" shall mean the Town of Tisdale, Province of Saskatchewan.
40) "Town Administrator" shall mean the Town Administrator of the Town of
Tisdale as defined in the Urban Municipalities Act.
41) "Traffic Light Signal" shall mean a lighted device whether manually,
electrically or mechanically operated, for the purpose of directing, warning
or regulating traffic.
42) "Traffic Marker" shall mean an object or thing used or intended to be used
for the purpose of channeling traffic on a street and includes a cone made of
rubber or other material.
43) "Trailer" shall mean a trailer or semi-trailer designed to be attached to a
vehicle, but shall not include any recreation vehicle or recreational trailer.

44) "U-turn" shall mean the act of turning or attempting to turn a vehicle in
such a manner as to proceed in the opposite direction. For the purposes of
this Bylaw the turn need not be completed to constitute a U-turn.
4.
Scope
a) "Stop" Streets:
All streets set out in Schedule "A" attached hereto and forming a part of this
Bylaw are established as "stop" streets, and the erection of stop signs for the said
streets at the intersections mentioned in Schedule "A" is hereby authorized.
b) "Yield" Streets:
All streets set out in Schedule "B" attached hereto and forming a part of this
Bylaw are established as yield streets and the erection of "yield" or yield right-of-
way signs on the said streets at the specified intersections are hereby authorized.
c) "No U-turn" Intersections:
All intersections as set out in Schedule "C" attached hereto and forming a part of
this Bylaw are established as "No U-turn" intersections, and the erection of "No
U-turn" signs at the said intersections is hereby authorized.
d) "Loading Zones":
No driver of a vehicle shall remain in the area between signs erected to designate
a loading zone at the locations set out in Schedule "D", for a period exceeding
five (5) minutes, for the purpose of embarking or disembarking passengers or for
the purpose of loading or unloading goods.
e) "Traffic Lights":
All intersections as set out in Schedule "E", attached hereto and forming a part of
this Bylaw, are established as dispatched intersections at which the movement of
traffic shall be controlled by traffic light signals and the erection and maintenance
of traffic light signals at the said intersections is hereby authorized. The
provisions of the Highway Traffic Act shall apply
to all traffic approaching and facing a traffic light signal erected and maintained
in accordance with the provisions of this Bylaw.
f) "Five Minute Parking Zone":
No person shall park a vehicle in front of the Tisdale Post Office Building for a
longer period than five minutes as set out in Schedule "F" attached hereto and
forming a part of this Bylaw.
g) "Bus Stop Parking Zone":
No person shall stop a vehicle in a bus stop between any of the times specified in
accordance with Schedule "G" attached hereto and forming a part of this Bylaw.

h) "Handicapped Parking Zone"
No person shall park a vehicle in the area between signs erected to designate
handicapped parking at the locations set out in Schedule "H", unless the vehicle
displays license plates indicating that the vehicle is eligible to be parked in a
handicapped parking zone.
i) "No Parking and Fire Lane Zones"
No person shall park a vehicle in the area between signs erected to designate no
parking or fire lanes at the locations set out in Schedule I.
j) Any driver who fails to obey a sign or signs erected in accordance with the
provisions of this section 4 is guilty of an offence.
5.
Infractions, Restrictions and Prohibitions
a) Stop Streets:
The highways as listed in Schedule "A" are designated as stop streets.
b) Yield Streets:
The highways as listed in Schedule "B" are designated as yield streets.
c) "No U-turn" Intersections:
1)
No person shall cause a vehicle to make a U-turn on any highway except at
a highway intersection which has not been posted with a "No U-turn sign in
accordance with Section 4(c) of this Bylaw.
2)
At any highway intersection where a U-turn is allowed, every driver of a
vehicle attempting a U-turn shall yield the right-of-way to all other vehicles
within the intersection or approaching the intersection.
d) Miscellaneous Signs:
1)
The Public Works Director is hereby authorized to erect and maintain on or
adjacent to any highway or parking lot in the Town any sign, traffic
marker, signal or light for the direction of traffic or parking of vehicles, in
accordance with the provisions of this Bylaw.
2)
No person shall erect upon or immediately adjacent to a highway any sign,
traffic marker, signal, or light or any advertising sign or device, except
where authorized by resolution of Council, a Police Officer, or the Public
Works Director, as herein provided.
3)
No person shall deface, injure, knock down, remove, obscure or interfere
with any warning or direction sign, traffic marker, barricade, signal or light
placed, erected or maintained pursuant to the provisions of this Bylaw.
e) Parking:
Method -
1)
Stop at Curb:
Every driver of a vehicle on a highway shall draw up to the right-hand curb
before stopping unless such stop be necessary to avoid collision or for the
purpose of immediately reversing the vehicle to place it at the curb or

unless the vehicle is required or authorized to be stopped in compliance
with this Bylaw.
2)
Parallel Parking:
i) Subject to subparagraph ii below notwithstanding the provisions of
Paragraph (c) hereof, no person shall park any vehicle on any street except
on the right-hand side thereof having regard to the direction in which the
vehicle was proceeding, with the right front and rear wheels not more than
thirty (30) centimeters from the curb. (Or where there is no curb with the
right front and rear wheels as near to the right-hand limit of the street as is
practicable) and where a parking stall has not been designated; a clear space
of at least sixty (60) centimeters shall be maintained in front and/or behind
any vehicle or vehicles previously in a parking position.
ii) On any street or parking lot where indicated by appropriate markings on
the street and/or appropriate signage that angle parking is applicable to that
street or parking lot, or a portion thereof, vehicles shall only be parked on
the angle and within a single parking space as indicated by the applicable
markings, or failing same, at an angle between 40 and 50 degrees in
comparison to the curb and not less than 60 centimetres from any
previously parked vehicle or vehicles.
3)
Handicapped Vehicle Parking:
i) No person shall park any vehicle in the handicap parking areas, as set
out in Schedule "H", as attached hereto and forming a part of this
Bylaw, unless such vehicle displays a valid Province of Saskatchewan
handicapped sticker.
ii) The provisions of Paragraph (i) above shall not apply in the case where
the owner or operator of a vehicle parked in a handicapped parking area
can prove that he is a handicapped person or that he did transport a
person to or from the said handicapped parking area.
4)
No Parking:
No person shall park a vehicle at any time on any street or portion of a
street, public place and fire lanes as set out in Schedule "I" attached hereto
and forming a part of this Bylaw. (BYLAW 18/12 AMENDMENT)
5)
Parking at Intersection:
i) No person shall park a vehicle within three (3) metres of any highway
intersection.
ii) No person shall park a vehicle within one (1) metre of any lane
intersection.
6)
Stopping in Lane:
i) No person shall stop a vehicle in any lane except in the ordinary course
of their business for such purpose as discharging or taking on cargo or
passengers.
ii) A person engaged in the ordinary course of his business may be parked
in any lane for the purpose of taking on or discharging cargo, provided
no such truck or vehicle shall be so parked for a period exceeding thirty
(30) minutes at one time.

7)
48 Hour Limit:
No person shall park a vehicle continuously on any highway or parking lot
of the Town or municipally owned property for a period exceeding 48
hours.
8)
Blocking Private Driveway:
No person shall park a vehicle on any highway or, lane in such manner as to
block an entrance to or exit from a private driveway.
9)
Fire Hall Entrances:
No person shall park a vehicle on any highway or property directly in front
of or in any other manner which obstructs a vehicular entrance to a fire hall.
10) Double Parking:
No person shall double park a vehicle, whether occupied or unoccupied.
11) Fire Hydrants:
No person shall park a vehicle within three (3) metres of any point on a
curb which is directly between a fire hydrant and a highway.
12) Private Property:
No person shall park any vehicle in any private parking place or on any
private property unless he is the owner, occupant, licensee or permittee of
the parking place or private property, except with the consent of such
owner, occupant, licensee or permittee.
13) Two Hour Trailer Limit:
No person shall park a trailer, whether attached to a vehicle or not, on any
highway for more than two hours at any time.
14) Parking of Unlicensed Vehicles:
No motor vehicle shall be parked on a highway unless it is displaying a
valid license plate or a valid permit.
15) Tisdale School Division and Cumberland Community College Parking.
No person who is an employee or student of the Tisdale School Division or
the Cumberland Community College while in attendance at the Tisdale
Middle and Secondary School or the Community College shall park his or
her vehicle in any Parking Lot located adjacent to or intended to serve the
building in which those facilities are located other than the Parking Lots
located directly West and North of the Tisdale Middle and Secondary
School.
f) Snowmobiles:
1)
No person shall operate a snowmobile on any highway in the Town of
Tisdale except in accordance with Subsection (2) and at a careful and
prudent speed having regard to all the circumstances, and at no time in
excess of the maximum speed permitted by this by-law for the location of
such operation.

2)
Highways shall only be used by snowmobile operators as the most direct
route to areas outside the Town limits or to areas where such use is
permitted within the Town.
3)
No person shall operate a snowmobile within the Town in such a manner as
to create a nuisance, hazard or annoyance to residents or other persons in
the Town.
4)
No person shall operate a snowmobile upon a parking lot.
5)
No person shall operate a snowmobile upon any property in such a manner
that is dangerous to other persons or property.
6)
No person shall operate a snowmobile abreast or beside another
snowmobile or vehicle on a highway.
7)
No person shall operate a snowmobile on any portion of the Provincial
Highways # 3 and #35 lying within the municipal boundaries except for the
sole purpose of crossing the highway at right angles to the highway.
g) Speed Limit:
1)
No person shall drive a vehicle within the Town of Tisdale except at a
careful and prudent speed having regard to all the circumstances and at no
time shall the speed exceed the limit as specified in Schedule "J" attached
hereto and forming part of this Bylaw.
2)
The areas set out in Schedule "J" as School Zones are hereby designated as
such, and the speed limit applicable thereto as set out in the Schedule shall
be effective from 8:00 a.m. to 4:30 p.m. Monday to Friday, and only when
schools are open and in session.
3)
The area set out in Schedule "J" as Playground Zones are hereby designated
as such, and the speed limit applicable thereto as set out in the Schedule
shall be effective from 9:00 a.m. to 9:00 p.m.
4)
Nothing contained in this section shall apply to the routes of the Provincial
Highways lying within the incorporate area of the municipal boundaries
where the speed limit has been established by the Province.
h) Heavy Vehicle Route:
1)
No person shall drive a heavy vehicle on any highway or portion of a
highway except those set out in Schedule "K" attached hereto and forming
part of this Bylaw. The highways or portions thereof as set out in Schedule
"K" are hereby established as "Heavy Vehicle Routes", and the erection of
signs to so identify the same is hereby authorized.
i)
Provided that this subsection shall not apply to any persons operating
a heavy vehicle owned by the Town of Tisdale while actually in use in
the service of the Town; and
ii)
Provided further that this subsection shall not apply to heavy vehicles
being operated for the collection or delivery of goods within the Town
limits. However, heavy vehicles proceeding to or from a point of
collection or delivery shall proceed to or from such point by the most
direct route to or from the heavy vehicle route; and
iii) Provided further that this subsection shall not apply to heavy vehicles
proceeding to or from a garage for the purpose of repairs or servicing

provided that the most direct route to and from the heavy vehicle route
be observed.
2)
Heavy vehicles are not permitted to park on any highway or parking lot
except:
i)
On the Heavy Vehicle Route; or
ii)
In zones designated as C1 Commercial, and C2 Commercial and M-
Industrial in the Town of Tisdale Zoning Bylaw No. 2/90, to permit
the loading or unloading of merchandise, provided, however, that
such loading or unloading of merchandise is restricted to such lengths
of time as is absolutely necessary.
iii)
In situations to which subclause (i), (ii)and (iii) of Subsection h(1)
above apply.
i) Bicycles:
1)
Using the Handle Bars:
No person shall drive a motorcycle or drive a bicycle without having at
least one hand on the handle bars.
2)
Reckless Riding:
No person shall drive a bicycle on a highway recklessly or negligently or at
a speed or in a manner dangerous to the rider or to the public. Bicycle riders
shall at all times operate their vehicles with due care and regard to the
nature and condition of the street and the traffic thereon.
3)
Every person riding a bicycle shall ride as close as possible to the right hand
curb, but this shall not apply when the rider is approaching an intersection
and indicates his intention to turn left by giving a visible signal.
4)
Bicycles on Streets:
No person shall leave a bicycle in a reclining position on a street, sidewalk
or public place in the town.
5)
No person shall operate a bicycle on a sidewalk.
6)
Mini-Bikes:
No person shall drive a mini-bike, or a two, three, or four wheeled
motorized vehicle that is not capable of being licensed under the Highway
Traffic Act of the Province of Saskatchewan, on any street, lane, sidewalk,
park, playground, public reserve or on any property owned or controlled by
the Town of Tisdale.
j) Parades:
1)
No parade shall be held in the Town without written permission first being
obtained from the Council who shall designate or approve the hour and
route of the parade. Any person desiring to hold a parade shall apply to the
Town Administrator in writing for a permit therefore not less than forty-
eight (48) hours before the time set for the commencement of the parade
and shall give full particulars thereof.
2)
No person shall hold, take part in, or be a member of a parade unless such
parade has been duly permitted or authorized as aforesaid.

3)
No driver of a vehicle nor any pedestrian shall cross through any parade or
in any way obstruct or interfere with the same.
k) Site Line Restrictions:
1)
The owner or occupant of a lot which abuts more than one street, at a
highway intersection, shall not grow, suffer to be grown or allow the
growth of any tree, shrub or plant; or build, suffer to be built, or maintain
any fence or other structure which:
i)
Exceeds a height of one (1) metre above the level of the edge of the
roadway nearest; and
ii)
Falls within a triangle of land formed by the intersection of the two
property lines on the intersecting streets and a line connecting points
on the said property lines each seven (7) metres from the intersection
of the said lot property lines.
2) The Council may, upon the report of a Police Officer, or Public Works
Director that a hedge, shrub, tree or fence situated at an intersection is
dangerous to traffic, by resolution order that; such hedge, shrub, tree or
fence be removed or shortened to such a height as may be deemed
necessary to overcome such danger. The provisions of S.130 of the Urban
Municipality Act, 1984 apply, mutatis mutandis, to any such order.
l) Miscellaneous Regulations for Vehicle Operation:
1)
Leaving Stationary Position:
No driver of a vehicle shall enter or cross a highway or a sidewalk from a
private road or driveway or a lane or alley unless he yields the right of way
to pedestrians and vehicles approaching on the sidewalk on highway.
2)
Fire Hoses:
No person shall operate a vehicle over a fire hose while the fire hose is in
use.
3)
No Splashing of Pedestrians:
When water, mud or slush is lying on any public highway, the driver of
every motor vehicle thereon shall so reduce the speed of and otherwise
operate his motor vehicle so as to avoid splashing any pedestrian.
4)
Driving on Playgrounds and Parks:
No person shall park or drive a vehicle other than a bicycle upon or across a
playground, park or public reserve within the corporate limits of the Town.
5)
Vehicles on Sidewalks:
i)
No person shall drive a vehicle within any sidewalk area, except at a
lane crossing or a public or private driveway crossing, and only if the
weight of the vehicle and load is such that it will not cause damage to
the sidewalk, curb or gutter.
ii)
No driver of a vehicle shall permit same to stand on any lane crossing
or public or private driveway crossing so as to
obstruct the crossing.

6)
Entering an Intersection:
No person driving a vehicle shall enter an intersection unless it is
possible to safely proceed without obstructing or interfering with the
passage of pedestrians or other cross traffic, unless required to do so
by the provisions of the Highway Traffic Act.
7)
Obstructing Traffic:
Except as permitted herein, no pedestrian or driver of a vehicle,
whether making deliveries from the vehicle or not, shall obstruct,
interfere with or interrupt the free passage of traffic on any highway or
lane.
8)
Power Turns:
No operator of a vehicle shall execute a power turn on any highway,
lane or parking lot in the municipality.
9)
Vehicles Crossing Streets:
No operator of a vehicle shall cause it to cross a highway except at an
intersection with another highway or a lane.
10) Boarding a Moving Vehicle:
While a vehicle is in motion, no person shall or attempt to step off or
board or catch or hold on to same.
11) Use of Streets for Business:
Except as may be authorized by Bylaw or resolution of the Council no
person shall engage in, conduct or carry on any business or display
any articles for sale, including a vehicle, on any highway, parking lot,
lane, or sidewalk or boulevard in the Town of Tisdale.
m) Jay-Walking:
Any pedestrian who enters onto or crosses 100A Street or 100th Street any place
other than within a Pedestrian Crosswalk is guilty of an offence.
n) Lug Vehicle:
1)
No person shall propel, operate or drive any lug vehicle upon any highway
within the municipality without first having obtained of the clerk, a permit
in writing authorizing same.
2)
The clerk is hereby authorized to issue permits in writing for the purpose of
this Bylaw in any case where the applicant therefore has signed a written
undertaking in Form 1, Appendix 8. Provided that the clerk shall not issue
any such permit unless he is satisfied that with reasonable care in operation,
the lug vehicle may be propelled or driven over any highway without
damage resulting thereto or to any bridge or culvert thereon.
3)
Nothing contained in this bylaw shall be deemed to preclude the transport
of a lug vehicle as herein defined over any highway where same is being
carried by means of a rubber-tired trailer or other conveyance equipped with
rubber tires.

6.
Temporary Street Closures:
a) Any highways or portion or portions thereof may be temporarily closed to
vehicular and/or pedestrian traffic and parking prohibited thereon by the Town
Administrator or Public Works Director for any of the following purposes:
1)
For a parade or an assembly of persons, including, but not limited to, street
dances, block parties and street sales.
2)
For the moving of any building, structure, or object.
3)
For the carrying out of any work, repair, maintenance or improvement, or
other duty or service the Town is empowered or obligated to perform.
4)
For the construction, demolition, improvement or repair of a building or
structure.
5)
For the protection of the public or any member thereof.
b) Any person requesting a temporary closure of a highway or any portion or
portions thereof for any reason set out in Subsection 6. A) (1), (2) or (4) shall
apply in writing to the Town Administrator or Public Works Director and shall
set out the reason or reasons for such request, the desired length of such closure,
the area or areas to be closed, and such other information as the Town
Administrator or Public Works Director may require.
c) The Town Administrator or Public Works Director may thereafter grant
permission for the temporary closure of a highway or portion or portions thereof
on terms consistent with the provisions of this section and for a period not
exceeding 24 hours.
7.
School Crosswalks
School crosswalks are hereby established at the highways set out in Schedule "L",
hereto attached and forming part of this Bylaw, and the following provisions shall
apply to each school crosswalk so set out:
a) All vehicles approaching a School Crosswalk which a pedestrian has entered
shall yield the right-of-way to the pedestrian by slowing down or stopping, if
necessary.
b) When a vehicle is approaching a School Crosswalk, the driver of any other
vehicle approaching from the rear of such vehicle shall not overtake and pass
such vehicle.
c) No pedestrian shall leave the curb or other place of safety at a School Crosswalk
and walk or run into the path of a vehicle that is so close that it is impracticable
for the driver of such vehicle to yield the right-of-way.
d) While School Patrols are operating in a School Crosswalk all vehicles shall obey
and respect the signs and signals of the School Patrols.
8.
Pedestrian Crosswalks
The provision set forth in Section 7 above shall apply to Pedestrian Crosswalks,
Mutatis Mutandis.

Emergency Control Measures

a) In the case of fire or other emergency in order to expedite traffic or safeguard
pedestrians any Police Officer may direct traffic in such manner as he may deem
necessary.
b) Every person shall comply with any traffic signal or direction of a Police Officer
given pursuant to this section.
c) The provisions of the Highway Traffic Act with respect to the use of emergency
vehicles shall apply notwithstanding the provisions of this Bylaw.
10.
School Bus Loading Zone
The following areas are hereby designated as School Bus Loading Zones:
a) The passageway immediately north of the Tisdale High School which is marked
with signs to that effect.
b) That portion of the parking lot immediately west of the Tisdale Public School
which is marked with signs to that effect.
No person shall operate a vehicle in a School Bus Loading Zone.
11.
Towing of Vehicles
a) Any vehicle parked in contravention of any provision of this bylaw may be towed
from its location to a suitable storage facility under the direction of any Police
Officer or the Town Administrator or any person designated by the Town
Administrator for that purpose.
b) Any vehicle so towed shall be held at the said storage facility until such time as
the owner thereof or any person on his behalf pays to the Town Administrator the
costs of towing and storing the vehicle as aforesaid, together with any fine
imposed under this bylaw in relation to such unlawful parking.
12.
Impounding of Vehicles
a) Any Police Officer, the Town Foreman, and other person appointed by Council
may remove or cause to be removed and impounded any vehicle that is placed,
left or kept on any lane, public parking place, or other public place where:
i) the owner of the vehicle owes three or more outstanding fines to the urban
municipality for parking offences;
ii) the period for appealing against the imposition and amount of those fines has
expired;
iii) at least two notices, sent at least one week apart, that the fines are outstanding
have been sent to the owner; and
iv) a justice, having been satisfied by evidence provided by way of oath, affidavit
or statutory declaration of the existence of the facts mentioned in clauses (a)
to (c), has issued an order authorizing the removal and impoundment.

b) Where a vehicle has been seized, impounded or stored after it has been removed
under Subsection 12(a), it may be retained at a public garage or at any place
designated by a Police Officer, for a period of 30 days from the date of removal,
unless the costs of the removal, impounding, or storage are sooner paid. Upon
payment in full of the costs herein the vehicle may be released to the owner
thereof.
c) If the costs of removal, impounding or storage are not paid within the period of
30 days as specified in Subsection 12(b), the Town shall have the right to recover
same from the owner of the vehicle by:
1)
Legal action in a court of competent jurisdiction; and/or
2)
Sale of the seized vehicle by public auction following publication of notice
designating time and place of sale at least ten days prior to the sale, in a
newspaper published in the Town, and on sending of such notice by
registered mail to the owner at the address appearing on the last registration
of the vehicle.
13.
Owner of Motor Vehicle
Where a Vehicle is involved in the commission of an offence pursuant to this bylaw,
the Owner of the Vehicle is liable for the offence unless the Owner proves to the
satisfaction of the court that, at the time of the offence, the Vehicle:
a) Was not being operated and had not been parked or left by the Owner; and
b) Was not being operated and had not been parked or left by any authorized person
in charge of the Vehicle.
14.
Penalties
a) A person who contravenes any of the provisions of the subsections, listed below,
of this Bylaw or fails to comply therewith or with any notice order given
thereunder shall be guilty of an offence and upon conviction, shall be liable to
penalties as follows:

b) 1.
A violator of any of the subsections as set out in subsection 12(a) upon
being served with a Notice of violation, may, during the regular office
hours, voluntarily pay the penalty at the Town Office, and upon payment as
so provided, that person shall not be liable to prosecution of the offence.
2.
Notwithstanding the provisions of subsection 12(a) if the said fine is paid
within 72 hours from the date of the ticket being issued the penalty shall be
reduced by 20% as indicated in said subsection.
c) A person who is guilty of a violation of any provision of this Bylaw for which no
other penalty is herein provided, is liable:
1)
For the first offence to a fine of not less than $100.00 or more than $230.00.
2)
For each subsequent offence to a fine of not less than $150.00 or more than
$460.00.
d) The penalty for the contravention of a provision of subsection 5(i) is as follows:
a)
for the first infraction, impounding the bicycle for seven (7) days.
b)
for the second or additional infractions impounding the bicycle for fourteen
(14) days.
e) In the event the Town is required to prosecute a person charged with an offence
under this by-law through court proceedings, and does so successfully, it shall be
entitled to recover from such person, in addition to the fine set out herein, all
legal costs which it incurs in the course of such prosecution, which costs shall be
added to and form part of the said fine.
15.
All proceedings to enforce this by-law shall be governed by the Summary Offences
Procedure Act, 1990 or any replacements or substitutions therefore.
16.
A Notice of Violation under this bylaw maybe in the form set forth in Schedule
"M" to this bylaw.
17.
Bylaw No. 1/98, 13/04, 12/05, 15/09, 14/10, 10/11 and 12/11 be hereby repealed.

18.
This Bylaw shall come into effect on the day of final passing thereof subject to the
sections requiring Highway Traffic Board approval.

NOTICE RESPECTING VOLUNTARY PAYMENT WITHOUT COURT APPEARANCE
Where the penalty for the above violation is $ _____________ or less, you may make
voluntary payment of the above penalty at the Town Office of the Town of Tisdale during
regular office hours or by mail within three (3) days from the date of service of this Notice of
Violation. The Town of Tisdale's mailing address is: P.O. Box 1090, Tisdale, SK., S0E
1T0.
If you do not make a voluntary payment within the time set out above, you shall be liable to
prosecution and upon summary conviction you shall be liable to the penalty provided under
Section 12 of the said Bylaw.
If the said fine is paid within 72 hours from the date of the ticket being issued the penalty
shall be reduced by 20%.
