## CITYOF WEYBURN ## BYLAWNO. 2024-3483 ## A BYLAW OF THE CITY OF WEYBURN, THE DEVELOPMENT OF SWIMMINGPOOLS INTHE CITYOF WEYBURN WHEREAS the Council of the City of Weyburn wishes to establish a swimming pool bylaw pr the purpose of regulating the design, construction and repair of private swimming pools hroughout the City of Weyburn in accordance with the general development regulations in he Zoning Bylaw, the Council of the City of Weyburn, in the Province of Saskatchewan, enacts as follows; ## TITLE 1. This bylaw be cited as the 'Swimming Pool Bylaw". ## PURPOSE 2. The purpose of this bylaw is to: - 1) provide guidance and administrative support to regulate the construction, maintenance and repair of private swimming pools as well as to, - 2) regulate and enforce safety measures of private swimming pools, ## DEFINITIONS 3. In this Bylaw: - 1) 'Bylaw" means the private Swimming Pool Bylaw; - 2) 'Private swimming pool" means an artificially created basin, lined with concrete, fiberglass, vinyl or similar material, intended to contain water for the use of persons for swimming, diving, wading or other similar activity, which is at least 06 metres in depth, and includes pools situated on top of the ground and hot tubs; - 3) 'Hot Tub' means an artificially created basin, lined with concrete, fiberglass, vinyl or similar material, intended to contain water for the use of the persons for swimming, wading, or similar activity, which is 0.61 metres (2 feet) or more in depth and; - 4) 'Enclosure" means any structure constructed of any material or any combination of material, which is a barrier and used to enclose or screen areas of land but does not include a building. The enclosure includes any doors or gates surrounding the swimming pool and restricting access to it; - 5) 'Occupant" includes a person residing at a property upon which a private swimming pool is situated, or a person entitled to the property's possession if there is no person residing there and a Ieaseholder; - 6) 'Owner' means a person who has a right, title, estate, or interest in a property upon which a private swimming pool is situated other than that of an occupant, tenant or mortgagee. ## PERMIT REQUIREMENTS - 4' No construction or alterations of a private swimming pool can occur without first obtaining: - 1) A development permit from the City of Weyburn for all inground pools. - 2) A building permit from the City of Weyburn for all pools and hot tubs if accompanied by a deck. - 5' No demolition of a swimming pool or hot tub can occur unless first obtaining a demolition permit ## SWIMMINGPOOLS 6. Notwithstanding anything contained in this Bylaw, a swimming pool is permitted as an accessory use to permitted use and shall meet the regulations of the Zoning Bylaw provided: <!-- image --> M-11 (a) - 1) The pool must be located in the rear yard or side yard for corner sites. - 2) No part of the pool should be located closerto any lot or street line than the minimum distance required for the principal building located on such lot in accordance with the zoning bylaw. - 3) All swimming pools must be structurally detached from any principal building or any additional accessory building with a minimum separation of 1 metre. ## HOT TUBS 7. In the case of a private swimming pool which is a hot tub the requirements ofthis Bylaw do not apply if all the following provisions are complied with: - 1) The hot tub does not exceed 2.4 meters across the widest portion of the water surface; - 2) The hot tub has a cover with the strength to support the weight of an adult walking across the top; - 3) The hot tub has a lockable device to prevent access to the water by unauthorized persons; and - 4) The cover is maintained in place and locked at all times when the hot tub is unsupervised. ## ABOVE GROUND POOLS 8. The requirements of this bylaw do not apply to an above-ground pool provided: - 1) the stairs, ladder, deck, or other ways to enter the swimming pool are enclosed by a permanent gated enclosure or, - 2) children's play pools or paddling pools which are designed and sold for toddler aged children, which are generally an inflatable type of pool or a pool which are under 0.6 metres in depth, 9. The sides of an above ground pool shall be a minimum of 1.2 metres in height from the finished grade and any climbable fixture on the exterior of the pool wall to the top rail of the pool wall. ## WATER SUPPLY 10. Any private swimming pool connection to a potable water supply shall be protected by an approved and functioning backflow preventer that will ensure that the water in the pool system does not flow back into the city's water supply and distribution system and shall comply with any other requirements of the bylaw or bylaws governing the city's water supply and distribution system. ## DRAINAGE 11. Allprivate swimming pools shall have and use a discharge system that allows the swimming pool to drain into the City's sewer system safely and securely into the City's sewer system. The rate of discharge must not exceed 90 litres per minute. 12. No person shall drain the water of their private swimming pool into the City's storm drain system. 13. No person shall drain the water of a private swimming pool into any adjacent private property or any public property including any street, lane, walkway, watercourse, or waterbody. ## ENCLOSURE/GATES 14. No person shall useor operate a private swimming pool unless it is enclosed in accordance with the provisions of this bylaw. Every enclosure shall be maintained in good working condition. 15. The enclosure must have a minimum height of 1.5 metres measured on the exterior, or non-pool, side from the top of the enclosure to the nearest platform, deck, or grade. CC CC 16. A gate which forms part of an enclosure must be installed to swing outward in the direction away from the swimming pool and equipped with a self-closing device designed to return the gate to the closed position after each use and where the gate will remain closed after each use. 17. When a swimming pool is not attended by the owner or occupant, gates, doors, and other entrances to the swimming pool area must be locked by a self-closing and selfIocking device. ## LOCATIONI WALKWAY 18. Any maintenance equipment including filtering, disinfectant and re-circulatlon equipment shall have a minimum of 1.5 metre separation from the property line and be enclosed to not affect abutting properties 19. A minimum of 0.75 metres must be reserved as a walkway surrounding the swimming pool within the enclosure. There are no requirements regarding the material that can be used for the walkway. 20. If the swimming pool is above-ground, the walkway shall be constructed so it is raised off the ground and is at least 1.2 metres from the top of the rim of the swimming pool to the ground, deck, or grade. 21. Any deck attributed to the swimming pool must have a minimum distance of 1.8 metres from the principal building and a side yard of 1.2 metres if attached to or abutting the principal building. Deck attachments must be in accordance with the Zoning Bylaw. 22. Any installed artificial lighting for the illumination of the swimming pool must be designed, installed, and maintained to not direct any rays across property lines. ## PENALTIES ' 23. Any person who contravenes this Bylaw is guilty of an offence and liable to the penalties provided in the General Penalty and Enforcement Bylaw of the City of Weyburn. ## COMING INTO FORCE 24.
