"Commercial Kenneling" means the keeping of multiple animals which are not owned by the keeper on behalf of other animal owners in exchange for payment.
"Commercial Breeding" means the whelping of a dog or cat for purposes of selling the offspring that animal for a profit where the owner of that animal has bred an excess of one litter of offspring from a single animal in a calendar year.
"Council" or "Town Council" means the Council of the Town of Wilkie.
"Cat" means and includes every cat of either sex.

"Animal Unit" means the kind and number of permitted animals calculated in accordance with
"Animal Shelter" or "Pound" means such premises and facilities as may be designated by the Town from time to time for the purposes of impounding an animal or otherwise bringing an animal into the Town's care.
"Animal Control Officer" shall mean any person designated by the Town of Wilkie for the entorcement of this Bylaw and shall include the designated Poundkeeper, Town employees, Bylaw Enforcement Officers, their duly authorized representatives, any member of the Unity/ Wilkie/ Macklin Detachment of the RCMP, and any practicing veterinary professional.
(C) an animal which is in a public space and is not under proper control of the owner by being tied or secured to a leash or chain or other similar restraining device not exceeding 1.5 meters in .
(b) an animal which is beyond the boundaries of any lands on which the landowner has given permission for that animal or animals generally to be, or an animal which is within the boundaries of land on which the landowner does not wish the animal to be;
"Animal at Large" or an animal being "at Large" means any of: (a) an animal which is off the premises and boundaries of the land or vehicle occupied or owned by that animal's owner, possessor, or harbourer;
"Animal" includes dogs, cats, exotic animals, wild animals and all domestic animals.
3. In this Bylaw:
## #I - DEFINITIONS
2. The purpose of this Bylaw is to promote the safety, health and welfare of people and the protection of people and property in the Town of Wilkie, to ensure the humane treatment and protection of animals, to regulate the ownership or harbourage of any animals and to prohibit animals being at large.
Il - PURPOSE
1. This bylaw may be referred to as "The Animal Control Bylaw."
1- SHORT TITLE
NOW THEREFORE, the Council of the Town of Wilkie, in the Province of Saskatchewan, enacts as follows:

(a) the Town of Wilkie or any Animal Control Officer who provides care for or is in control of an Animal or operates an Animal Shelter, Feeding Station, or Pound on behalf of the Town.

"Feral" means an animal at large which is not owned or controlled by any person.
"Exotic Animal" means those set out in Schedule "D" and Schedule "E". "Feeding Station" means any location where food is regularly deposited by any person for the purpose of feeding feral or stray animals or animals which are not otherwise under the control of an owner.

IV - LICENSING

b. No owner of an animal shall permit their animal on any public playground, park or public area without a leash or restraint except for a specific activity approved by the Parks & Recreation Department of the Town.
a. If an animal is found to be at large, the owner shall be deemed to have permitted the animal to be at large unless the owner proves to the satisfaction of the Animal Control Officer, that at the time of the offence the owner did all that was reasonable to prevent the animal from being at large.
15. No owner shall at any time allow any animals in their control to run at large within the municipality.
## VI - ANIMALS AT LARGE
c. If an owner, household, property or residence continues to keep or harbour animals in violation of this section such that the Animal Control Officer has issued and the owner has failed to pay three consecutive fines, the Municipality may add the total amount of the fines to the Tax Roll of the property in which the animals are being kept or harboured.
b. If an Animal Control Officer observes an owner, household, property, or residence to be keeping or harbouring animals in violation of this section and the owner is unable to provide satisfactory evidence that the animals are not regularly kept on the premises in question, the Animal Control Officer may issue a fine to the owner pursuant to Schedule "C".

If an owner desires to have more than the maximum allowable number of animals in their residence, they must first make written application to Council for approval and shall pay the applicable licensing fee for all animals in their residence prior to obtaining permission for the same. The Town may in its sole discretion grant permission for a household to keep more than the maximum allowable number of animals; failure to obtain permission is a violation of this Bylaw.
12. The number of animals allowed per home shall be established at a maximum of two (2) cats and a maximum of two (2) dogs, regardless of the number of potential animal owners residing in the home.
## V - NUMBER OF ALLOWABLE ANIMALS

If the owner is unable to produce this evidence and if the Town bears no record of the owner's licensing fee being paid for the licensing year, the Animal Control Officer may issue a Notice of Violation directing the owner to pay the licensing fee and any applicable penalty.

If a cat which was believed to be feral is subsequently claimed by an owner, that owner shall be liable for the penalties set out in Schedule "B", any applicable licensing fee, and any fees incurred pursuant to Schedule "C" or by the Town or the service provider in preparing the animal for adoption prior to having service provider.
24. Cats which are determined by an Animal Control Officer to be feral shall at the Poundkeeper's discretion be exempt from the 72-hour impoundment holding period and shall be transported to a service provider to be sterilized before being put processed for adoption or returned to the Municipality at the direction and discretion of Council. Feral cats which are unsuitable for sterilization will be humanely euthanized by the by Council and overseen by an Animal Control Officer.
23. Feeding stations for feral or otherwise un-owned cats shall not be permitted at any time unless approved

18. No person shall construct or cause to be constructed, a dog run in the Town of Wilkie within one (1) meter of the property line or within five (5) metres of a neighbouring dwelling unit.
## VII - DOG RUNS & RESTRAINTS
17. All animal owners shall promptly notify the Poundkeeper if an animal in their care goes missing or is otherwise believed to be at large. If sufficient notice is given by the animal owner to the Poundkeeper and the animal is properly licensed, the Poundkeeper may in their sole discretion waive the "animal-at-large" fine described in Schedule "C".
16. Any animals found to be at large may be retained and impounded by an Animal Control Officer in accordance with The Stray Animals Act and the owner is liable for all fees incurred by the Municipality as set out in Schedule "B" to this Bylaw and all applicable fines as set out in Schedule "C" to this Bylaw.

38. In the case of an emergency for any cause, but more particularly for the infectious disease, the Poundkeeper or a Medical Health Officer is authorized to order that no owner shall permit his dog or cat

37. Any person found in breach of this Section shall be liable to the penalties set out in Schedule "B" and Schedule "C" as if the animal were an unlicensed dog or cat.

Only those properties zoned as Future Urban Development and which have an agricultural assessment that includes a minimum of 5 acres of agricultural land, will be eligible to keep any animal set out in b. The person to whom permission has been granted will file with the Municipality a list of all animals and the number of each on their property by January 31s of each year.

33. No person shall keep, possess, harbour, herd, graze or confine livestock or any animal other than cats, dogs, or permitted exotic animals in any part of the Town without first obtaining written permission of Council or as described in this section.
## X- POSSESSION OF LIVESTOCK AND OTHER DOMESTIC ANIMALS

32. Any person found in breach of this Section shall be liable to the penalties set out in Schedule "B" and The Captive Wildlife Regulations.

47. Notwithstanding Section 375 of the Municipalities Act, the Poundkeeper may impound any animal within
the Municipality which the Poundkeeper believes to be at risk of becoming an animal at large or which the then Section 375 of the Municipalities Act shall apply.

46. If a complaint is made that a dog:
45. The owner of a female animal in heat shall keep such animal confined to a house or outdoor shelter. If an owner fails to enforce this confinement they are liable for penalties set out in Schedule "C" to this bylaw.
a. Upon receiving a formal complaint regarding an animal creating a disturbance, an Animal Control Officer may issue a Ticket of Violation directing the animal owner to pay the prescribed penalty.
44. No owner of an animal shall permit the animal to be or become a nuisance by barking or howling or by making any other offensive noise to the annoyance or discomfort of any person at any time of day or night. For the purpose of this section, an animal is creating a disturbance if a person not situated on the property where the animal is located can easily hear the disturbance.
## XIII - NUISANCE
43. All commercial operations based upon Future Urban Development or Residential Acreage land must pay all applicable licensing fees in compliance with Town of Wilkie Bylaw no. 10/18 - Business Licensing any applicable business development or business permitting processes.
42. Council may grant permission for the operation of commercial breeding or kenneling facilities subject to commercial activities.

40. An owner of a cat or dog who neglects or refuses to comply with the direction of the Poundkeeper or order of the Medical Health Officer made under the provisions of this Section shall be guilty of a breach of this Bylaw and liable for penalties set out in Schedule "C" to this Bylaw.
39. The Poundkeeper may order the compulsory inoculation of any animal if the owner is unable to produce records demonstrating the animal is appropriately inoculated.

## XVI - ENFORCEMENT

61. No person, whether or not he is the owner of an animal which is being or has been pursued or seized shall:

The Poundkeeper shall keep a record of all animals impounded in accordance with the provision of this Bylaw and the disposal of such animals and shall supply the Town with a monthly report and any other information which may, from time to time, be required by Council respecting the enforcement of the claimed within a further 72 hours, the animal shall be processed as described in this section.

written notice to the owner at the residence to which the animal is registered. It the animal is not
57. When an animal impounded is wearing a collar to which is attached a licence tag valid for the current year, the Animal Control Officer shall immediately give notice by any effective means to the owner of the animal as shown in the records made when the licence was purchased at the address shown therein, that unless the said animal is claimed and the fees, as provided for in the Bylaw, are paid within 72 hours or three working days from the date of the notice, the said animal shall be processed pursuant to the provision of

73. This Bylaw shall come into force and take effect on the date of the final passing thereof.
72. Bylaw No. 2021-03 "The Animal Protection Bylaw" is hereby repealed.
71. Bylaw No. 2022-03 "The Keeping of Animals Bylaw" is hereby repealed.
## XVII - COMING INTO FORCE
70. The Council may, by resolution, enter into an agreement with any person or organization for the purpose of participation in the enforcement of this Bylaw or for the purpose of providing pound keeping and animal
69. Any amounts owing by an animal owner to the Town as identified in a Notice or Notices of Violation may be added to the Tax Roll for the animal owner's residence if unpaid for more than thirty calendar days pursuant to s. 369 of The Municipalities Act. Property-owners whose tenants are animal owners shall be held liable for any and all contraventions of this Bylaw which their tenants may commit.
68. The Court may, in default of payment of a fine imposed under this Bylaw, order imprisonment of an individual for a term not exceeding one year.
b. in the case of a corporation, to a fine of not more that $5,000.
a. in the case of an individual, to a fine of not more that $2,000; and
67. Except as otherwise provided in this Bylaw, every person who contravenes any provision of this Bylaw is guilty of an offence and liable on summary conviction:
e. Where the Poundkeeper or a designated Animal Control Officer finds a person has contravened the provisions of any of the Sections of the Bylaw, he may serve or cause to be served upon such person a Summary Offense Ticket in the place of a Notice of Violation Ticket.

d. A person to whom a ticket is being issued pursuant to this section shall furnish any Animal Control c. If payment is not received as provided in subsection (b) hereof within the time prescribed, the amount of the fine shall increase as described in Schedule "C" and a Summons shall be issued. Thereafter, voluntary payment may be made before the returnable date of the Summons to the Town Office and the penalty shall be in the amount listed in Schedule "C" and an additional penalty of $50.00 if a Summons has been issued. Upon such payment, the person charged shall not be subject to further court action.
b. Upon production of the ticket issued pursuant to subsection (a) within ten days from the date of service, together with payment indicated on the ticket to the Town Office, the person to whom the ticket was issued shall not be liable for prosecution for the contravention in respect of which the ticket was given.
a. The Ticket shall indicate the contravention in question and state thereon the amount of the penalty to be paid pursuant to Schedule "C" of this Bylaw.

5. This Schedule "A" comes into effect concurrent with the whole of Bylaw no. 2026-08.
4. Pursuant to Section IV of Bylaw no. 2026-08, no owner, household, property or residence shall be permitted to have more than five cats or dogs, or combination thereof, over the age of three months old, without the express discretionary permission of Council.
3. The licensing fees herein are non-refundable.
