## VILLAGE OF MAYO ## BY-LAW # 242 ## A by-law to provide smoke-free environments within Village of Mayo facilities and vehicles. WHEREAS Section 265 of the Municipal Act, being Chapter 19, Statutes of the 'ukon Territory and amendments, provides that Council may by by-law provid or the protection, safety, health and welfare of people and provide for th enforcement thereof; and WHEREAS smoking is proven to be a major cause of heart and lung disease and detrimental to health; and WHEREAS Council deems it necessary to provide smoke-free environments for children, youth, adults, and seniors in Village of Mayo facilities and vehicles, NOW THEREFORE pursuant to the provisions of the Municipal Act of the Yukon Territory, the Council of the Village of Mayo, in open meeting assembled, HEREBY ENACTS AS FOLLOWS: ## 1.00 SHORT TITLE - 1.01 This By-law may be cited as the "No Smoking By-law". ## 2.00 DEFINITIONS - 2.01 In this By-law, wherever the male gender is specified, it shall be interpreted as including both male and female as applicable; and - 1) VILLAGE means the Village of Mayo. - COUNCIL means the Municipal Council of the Village of Mayo. - 3) PATIO/DECK means an outdoor area without solid wall cladding and has open-air ventilation. - SMOKE-FREE means no smoking of cigarettes, cigars, pipes, or any other smoke-producing products. - SMOKING AREAS means any area where smoking is permitted under this by-law. ## 3.00 GUIDELINES - 3.01 1) All municipal indoor facilities and vehicles are to be smoke-free environments. ## 4.00 DESIGNATED SMOKING AREAS - 4.01 1) Outdoor smoking is permitted on a patio/deck provided the patio/deck meets the definition in this by-law. ## 5.00 PENALITIES - 5.01 Any person who contravenes this by-law is guilty of an offence under this by-law and will be asked to leave the premises. ## 6.00 ENACTMENT - 6.01 The provisions of this By-law shall come into full force and effect upon the final passing. <!-- image --> <!-- image --> <!-- image --> Read a First and Second time this Read a Third time and Passed this 20 \_day of December, 2006. day of Jenuwy - 2007.
