## A BYLAW TO PROHIBIT OBSTRUCTIONS ADJACENT TO CERTAIN ROAD ALLOWANCES PURSUANT TO SECTION 206 (2) (N) OF THE RURAL MUNICIPALITY ACT, 1989.
The council of the Rural Municipality of Walpole No. 92 in the Province Saskatchewan, enacts as follows:
1. For the purpose of this bylaw the expression:
2. (b) "road" means any road allowance within the municipality other than:
3. (a) "municipality" means the Rural Municipality of Walpole No. 92 of Saskatchewan;
4. a private road; or
5. road or highway within the following hamlets, to wit: Parkman, Mair, Kelso, and Walpole.
6. a provincial highway; or
2. No person shall hereafter plant trees or shrubs or place stone, earth or gravel piles, portable structures, machinery or other objects on private property -
- within three hundred feet (300 feet) from the intersection of two or more roads; or
- within one hundred and fifty feet (150 feet) from the centre line of any road.
3. The council may, by order, direct the owner of property upon which a tree or shrub has been planted, or a earth or gravel pile, portable structure, machinery or other object has been placed in contravention provisions of Section 2 hereof, to remove the time stated in such order and the provisions of Section 173 of The Rural Municipality Act, 1989, shall apply, mutatis mutandis, if the owner fails to comply with the order.
4. Any person who contravenes the provisions of Section 2 hereof is guilty of an offence and liable on summary conviction to the penalties imposed in the general penalty bylaw of the municipality.
12. Nothing Section 3 hereof shall apply with respect to shrubs planted more than five years prior to the passing of this bylaw, where such brush, trees
13. (a) are used as a shelter belt; and
14. (b) are situated within one hundred and fifty feet (150 feet), but more than seventy-five feet (75 feet), from the centre line of a road at a place other than an intersection of roads.
6. Bylaw No. 1/68 is hereby repealed.
